About modification and amendments in the Judicial code of the Republic of Armenia

Article 1. Regarding 1 article 37 of the Judicial code of the Republic of Armenia of February 21, 2007 (further – the Code) to replace figure "16" with figure "26".
Article 2. Add the code with Article 75.1 of the following content:
"Article 75.1. Provision of pensions of person holding judgeship
1. Person staying in position as the judge at least 10 years whose powers are stopped by Items 1 and 5 of part of 1 Article 167, and also on the bases, stipulated in Item 2 parts 4 of this Code is granted pension in the amount of 55 percent from the work of total amount of the average salary received on post as the judge within the last 1st year on coefficient zero whole nine tenth.
2. The size of the pension granted to person holding judgeship cannot exceed 92 percent of official pay rate, stipulated in Clause 75 Judicial codes of the Republic of Armenia on the last post as the judge.
3. In case of increase in official pay rate of the judge recalculation of the size of pension is made in proportion to increase in official pay rate, stipulated in Clause 75 Judicial codes of the Republic of Armenia on the last post as the judge.
4. The procedure for calculation of the average salary and years of service, appointment (recalculation), pension payment to person holding judgeship, and also the list of the documents necessary for award of pension are established by the Government of the Republic of Armenia.".
Article 3. Final and transitional provisions
1. This Law becomes effective since January 1, 2013.
2. Person holding judgeship after the introduction of this Law in force is granted stipulated in Clause 75.1 Codes pension instead of pension and the monthly surcharge established to it appointed under the Law of the Republic of Armenia "About national pensions".
