3. The judge refuses adoption of the statement for pronouncement of the writ on the bases, stipulated in Article 134 of this Code and also if:

1) the requirement, not stipulated in Article 122 of this Code is declared;

2) the residence or the location of the debtor is outside the Russian Federation;

3) from the statement and the submitted documents availability of dispute on the right is seen.

4. About return of the statement for pronouncement of the writ or about refusal in its acceptance the judge within three days from the date of receipt of the petition takes out determination.";
