About metrology and metrological activities

This Law governs the relations arising in production process of metrological activities.

Section I General provisions

Article 1. Basic concepts

1. In this Law the stated below terms are used in such value:

1) secondary standard - the standard established by calibration on primary by standard for the size of the same sort;

2) the state standard - primary or secondary standard, being in state-owned property;

3) expert checking of means of the measuring equipment - checking which is carried out in case of matters of argument of metrological characteristics, suitability to application and correctness of operation of means of the measuring equipment;

4) standard - realization of determination of this size with the established value of size and the related uncertainty of measurement, is used as basis for comparison. Standards can be primary, secondary and working;

5) unity of measurements - condition of measurements in case of which their results are expressed in the units of measure determined by this Law and characteristics of errors or uncertainty of measurements are known with certain probability and do not overstep the established bounds;

6) means of the measuring equipment - measuring instrument, measuring systems, material measures, standard samples and any parts of measuring instruments or measuring systems if these parts can be subject of special requirements and separate assessments of conformity;

7) approval like means of the measuring equipment - the decision of the appointed conformity assessment body accepted on the basis of the valuation report of type that the type of means of the measuring equipment conforms to the established requirements and can be used in the field of legislatively regulated metrology by method in case of which it, as expected, will provide reliable results of measurements during the certain period of time;

8) inspection checking of means of the measuring equipment - checking of means of the measuring equipment which is carried out when implementing metrological supervision;

9) calibrating laboratory - the company, the organization or their separate division performing calibrations of means of the measuring equipment;

10) calibrations - set of transactions by means of which under the set conditions at the first stage the ratio between values of size is established are provided with samples with uncertainty of measurements inherent in them, and to the corresponding indications with the related uncertainty of measurements, and at the second stage this information is used for establishment of ratio for receipt of result of measurement from display;

11) category of legislatively regulated means of the measuring equipment - set of legislatively regulated means of the measuring technology of the same appointment;

12) metrological activities - the activities connected with ensuring unity of measurements;

13) metrological traceability (traceability) - property of result of measurements which is that this result can be connected with standard through it is documented continuous chain of calibrations, each of which makes the contribution to uncertainty of measurement;

14) metrology - science about measurements and their application;

15) No. 2740-VIII is excluded according to the Law of Ukraine of 06.06.2019;

16) primary standard - the standard established with use of primary reference measurement technique or is created as the artifact chosen under the agreement;

17) periodic checking of means of the measuring equipment - the checking which is carried out during the period of operation of means of the measuring equipment through the established period (intertesting interval);

18) checking of means of the measuring equipment - the set of transactions including check and marking and/or issue of the document on checking of measuring instrument are established and confirm what specified means conforms to the established requirements;

19) testing laboratory - the company or the organization or their separate division, carries out checking of means of the measuring equipment;

20) repeated check - the inspection which is carried out for factual determination of elimination of violation of the metrological requirements provided in the corresponding instruction;

21) extraordinary checking of means of the measuring equipment - checking of means of the measuring equipment, is carried out in the following cases:

in need of the applicant to be convinced of suitability of means of the measuring equipment to application;

in case of damage of print of testing brand and if such brand is not provided - in case of loss of the certificate on checking;

the paragraph the fourth is excluded according to the Law of Ukraine of 06.06.2019 No. 2740-VIII;

21-1) working standards - standard which is used for regular calibration or checking of means of the measuring equipment;

22) the subject of managing - the legal entity (the company, organization, the organization) registered in the procedure established by the legislation irrespective of legal form and pattern of ownership (further - the companies and the organizations) and the physical person - the entrepreneur, performing activities in the territory of Ukraine;

23) measuring instrument Type - set of the means of the measuring technology of the same appointment having the same principle of action, similar design and made on the same technical documentation;

24) the packed-up goods - are held for sale the goods packed into absence of the final consumer, at the same time goods quantity in packaging has the certain value specified on the packaging corresponding in advance chosen to nominal rate and which cannot be changed without opening of packaging or its visible damage.

Article 2. Legislation of Ukraine on metrology and metrological activities

1. The legislation of Ukraine on metrology and metrological activities consists of this Law and other regulatory legal acts governing the relations in this sphere.

2. If the international treaty of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine establishes other rules, than those which are stipulated by the legislation Ukraine about metrology and metrological activities are applied rules of the international treaty.

Article 3. Sphere of legislatively regulated metrology

1. The sphere of legislatively regulated metrology is the types of activity determined by this Law concerning which for the purpose of ensuring unity of measurements and traceability state regulation concerning measurements, units of measure and means of the measuring equipment is performed.

To the sphere of legislatively regulated metrology the following types of activity belong:

1) ensuring protection of life and protection of public health;

2) quality control and safety of foodstuff and medicines;

3) control of state of environment;

4) control of safety of working conditions;

5) control of traffic safety and technical condition of vehicles;

6) land, cartographic and hydrometeorological works, works on land management;
