About entering of amendments into the Instruction about procedure for making of notarial actions
Based on the paragraph of the eighteenth subitem 6.20 of Item 6 and Item 11 of the Regulations on the Ministry of Justice of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of October 31, 2001 No. 1605, the Ministry of Justice of the Republic of Belarus DECIDES:
1. Bring in the Instruction about procedure for making of notarial actions approved by the resolution of the Ministry of Justice of the Republic of Belarus of October 23, 2006 No. 63 (The national register of legal acts of the Republic of Belarus, 2006, No. 188, 8/15268; 2008, No. 304, 8/19998), following amendments:
1.1. to add part one of subitem 103.5 of Item 103 with words "(further - HPK)";
1.2. add the Instruction with Chapter 35 of the following content:
"Chapter 35 Providing the proofs necessary for business management in bodies of foreign states, and also written proofs for hearing of cases in courts of the Republic of Belarus
293. According to article 96-1 of the Law of the Republic of Belarus "About notariate and notarial activities" the notary provides the proofs necessary for business management in bodies of foreign states (further if other is not established by this Instruction, - proofs), according to the written application of person who addressed for making of notarial action (further - the statement), to the addressed notary.
Making of notarial actions for providing the proofs necessary for business management in bodies of the foreign states, and also document creation connected with their making is performed by the rules established by GPK and HPK and other acts of the legislation of the Republic of Belarus.
To persons specified in the statement as interested persons, the notary directs the notice on time and the place of providing proofs. Absence of such persons to the place of providing the proof and at the right time, specified in the notice, is not obstacle for accomplishment of actions for providing the proof.
