About modification and amendments in the order of the Government of the Republic of Kazakhstan of October 30, 2009 No. 1729 "About approval of Rules of the organization and carrying out purchase of medicines, preventive (immunobiological, diagnostic, disinfecting) medicines, products of medical appointment and medical equipment, pharmaceutical services in rendering the guaranteed amount of free medical care"

The government of the Republic of Kazakhstan DECIDES:

1. Bring in the order of the Government of the Republic of Kazakhstan of October 30, 2009 No. 1729 "About approval of Rules of the organization and carrying out purchase of medicines, preventive (immunobiological, diagnostic, disinfecting) medicines, products of medical appointment and medical equipment, pharmaceutical services in rendering the guaranteed amount of free medical care" (SAPP of the Republic of Kazakhstan, 2009, Art. No. 47-48, 444) the following changes and amendments:

1) in Rules of the organization and carrying out purchase of medicines, preventive (immunobiological, diagnostic, disinfecting) medicines, the products of medical appointment and medical equipment, pharmaceutical services in rendering the guaranteed amount of free medical care approved by the specified resolution:

in Item 2:

3) to state the subitem in the following edition:

"3) customers are administrators of budget programs of health care, public institutions, and also the state companies, legal entities, fifty and more percent of voting shares (shares) of which belong to the state, and the legal entities performing purchase of goods and services according to these rules, and also the civil legislation of the Republic of Kazakhstan, except for the state bodies and public institutions acquiring medical equipment for rendering the guaranteed amount of free medical care, treatment and prevention of epidemiological diseases, national managing holdings, national holdings, national managing companies, the national companies and the legal entities affiliated with them;";

add with the subitem 35) in the following edition:

"35) the investment project - the complex of actions providing investments on creation of new productions, upgrade of the operating productions of medicines according to standards of proper production practice (GMP) and products of medical appointment according to the ISO standards 13485;";

add with part of the following content:

"When carrying out monitoring of the prices the authorized body does not consider the price of the medicines, products of medical appointment which are purchased from the organizations founded by the General Assembly of the United Nations.";

7) of Item 8 to state the subitem in the following edition:

"7) the potential supplier of medicines, preventive (immunobiological, diagnostic, disinfecting) medicines and/or products of medical appointment shall have the status of the producer or official manufacturer representative of the medicines offered to purchase, preventive (immunobiological, diagnostic, disinfecting) medicines and/or products of medical appointment. The potential supplier of medical equipment shall have the status of the producer either official distributor, or the official manufacturer representative having the agreement or other documents confirming its right to realization of the medical equipment offered to purchase;";

1) of Item 13 to state the subitem in the following edition:

"1) medical equipment according to the Code and procedure established by authorized body in the field of health care shall be registered in the Republic of Kazakhstan or is imported on the territory of the Republic of Kazakhstan without state registration on permission of authorized body in the cases provided by the Code with submission of the conclusion (the allowing document) about the admission of import to the territory of the Republic of Kazakhstan or the document confirming lack of need for registration of the offered medical equipment, issued by authorized body in the field of health care;";

in Item 39:

2) to add the paragraph of the seventh of the subitem with the offer the second the following content:

1-2) delivery schedules of medicines, products of medical appointment confirmed with producer or manufacturing plant according to the registration certificate;";
