About introduction of amendments to the Law of Ukraine "About advertizing"

The Verkhovna Rada of Ukraine decides:

1. Introduce in the Law of Ukraine "About advertizing" (Sheets of the Verkhovna Rada of Ukraine, 2004, No. 8, Art. 62 with subsequent changes) the following changes:

Article 1 after the paragraph of the seventeenth to add 1) with the new paragraph of the following content:

"Telesale - broadcast on television direct public offer to sign the purchase and sale agreement on certain goods".

With respect thereto the eighteenth - the twentieth to consider paragraphs respectively paragraphs the nineteenth - the twenty first;

To add 2) with Article 5-1 of the following content:

"Article 5-1. Telesale

1. Telesale shall contain necessary, available, reliable audiovisual information about the goods offered.

2. Time of broadcasting and share of telesale current of astronomical days and/or hour taking into account the features established by this Article join and are components of general time of broadcasting and the shares of advertizing and teletrade determined by this Law in the actual amount of broadcasting for astronomical days and/or hour by the teleradio organizations of any pattern of ownership.

3. On telesale the requirements determined by parts three - the fifth article 13 of this Law, expatiate on features of advertizing on television.

4. Teletrade shall not induce children to sign sales agreements or loan of goods.

5. Restriction of time of broadcasting and share of telesale the current of astronomical days and/or hour determined by parts one and the second article 13 of this Law do not extend to the broadcast channels specialized from telesale, and also broadcast of telesale in the form of the separate program and/or transfer (TV shop) are not specialized on telesales by broadcast channels on condition of observance of the requirements provided by part seven of this Article.

6. The restriction of share of advertizing within astronomical hour of the actual broadcasting determined by part two of article 13 of this Law does not extend to the broadcast channels specialized from telesale.
