About modification and amendments in the Instruction about procedure for making of notarial actions

1. Bring in the Instruction about procedure for making of notarial actions approved by the resolution of the Ministry of Justice of the Republic of Belarus of October 23, 2006 No. 63 (The national register of legal acts of the Republic of Belarus, 2006, No. 188, 8/15268; 2008, No. 304, 8/19998; 2010, No. 251, 8/22846; 2011, No. 55, 8/23626; National legal Internet portal of the Republic of Belarus, 15.01. 2013, 8/26730), following changes and amendments:
1.1. state Item 66 in the following edition:
"66. The pledge agreement of property and (or) property rights (requirements) in ensuring agreement obligation which shall be notarially certified is subject to the notarial certificate.
The notary certifies the pledge agreement of property, including property of citizens on which the address of collection is not allowed if pledge of such property the law is not prohibited or is not limited.
The notary certifies the agreement on mortgage taking into account the requirements established by the Law of the Republic of Belarus of June 20, 2008 "About mortgage" (The national register of legal acts of the Republic of Belarus, 2008, No. 157, 2/1442).
The property cannot be mortgage subject if on it according to the civil procedural legislation collection according to executive documents cannot be turned and also if the property is acquired at the expense of external state loan (credit), before complete repayment of obligations on such loan (credit).
