"3. Based on separate decisions of the Government of the Russian Federation the means specified regarding 1 this Article, returned later execution of obligations by credit institutions on the subordinated credits (loans) specified regarding 1 Article 6 and part 1 of article 6.1 of this Federal Law can be directed to acquisition of preferred shares of the credit institutions which fulfilled the specified obligations.
4. The acquired at the expense of the means specified in part 3 of this Article, preferred shares are not considered when calculating share of preferred shares (nominal value of the placed preferred shares) in total amount of the authorized capital of joint-stock company for the purpose of Item 1 of Article 102 of the Civil code of the Russian Federation and Item 2 of article 25 of the Federal Law of December 26, 1995 No. 208-FZ "About joint-stock companies", requirements of Item 2 of article 32 of the specified Federal Law on obligatory determination in charter of joint-stock company of the size of the dividend and (or) the cost paid in case of liquidation of society (salvage value) according to preferred shares do not extend to such preferred shares. In case of transactions with the specified preferred shares (including during their release and placement) provisions of Chapters X and XI of the Federal Law of December 26, 1995 No. 208-FZ "About joint-stock companies" are not applied.
