I. General provisions

1. Rules of maintaining books of accounting of documents and cases of documents of title in case of state registration of the rights to real estate and transactions with it (further - Rules) according to the Federal Law of July 21, 1997 No. 122-FZ "About state registration of the rights to real estate and transactions with it" <1> (further - the Law) establish procedure for maintaining books of accounting of documents, single for the Russian Federation, and cases of documents of title.

2. Maintaining books of accounting of documents and cases of documents of title perform:

Federal Registration Service (further - the body performing state registration of the rights) - in case of state registration of the rights, restrictions (encumbrances) of the rights to the companies as the property complexes, real estate units located in the territory of more than one registration district (linear constructions - the real estate units which are difficult or indivisible things), and transactions with them, and also on other real estate units in the cases provided by regulatory legal acts of the Russian Federation;

territorial authorities of Federal Registration Service (further - the territorial authorities of the Federal Registration Service, bodies performing state registration of the rights) - in case of state registration of the rights, restrictions (encumbrances) of the rights to the real estate units located in the territory of the respective registration district, and transactions with them and also for the real estate units located in the territory of other registration districts, and transactions with them in the cases provided by regulatory legal acts of the Russian Federation.

Based on decisions of the Federal Registration Service maintaining books of accounting of documents performs federal state budgetary institution also subordinated to the Federal Registration Service (its territorial subdivisions) (further - federal state budgetary institution, the body performing state registration of the rights).

3. Books of accounting of documents and case of documents of title are integral part of the Unified State Register of Rights on real estate and transactions with it (further - EGRP; Item 2 of article 12 of the Law).

Books of accounting of documents and business of documents of title are run on paper and (or) electronic media.

4. Books of accounting of documents are kept on electronic media with use of the automated information system. Books of accounting of documents are kept on papers in the cases established by the legislation of the Russian Federation.

6. The bodies performing state registration of the rights keep the following books of accounting of documents:

the book of accounting of arrests, prohibitions of transactions with real estate units, other restrictions (encumbrances) of the rights to real estate units.

name of the book of accounting of documents;

the name of the body conducting it performing state registration of the rights including divisions of territorial authority of the Federal Registration Service (department, branch of federal state budgetary institution);

number of the book of accounting of documents;

start and end dates of work with the book of accounting of documents.

8. Number of the book of accounting of documents is created as follows:
