About modification and amendments in the order of the Government of the Kyrgyz Republic "About licensing of separate types of activity" of May 31, 2001 No. 260

For the purpose of improvement of quality of education and private sector development in the field of education, according to article 5 of the Law of the Kyrgyz Republic "About licensed authorization system in the Kyrgyz Republic" and articles 10 and 17 of the constitutional Law of the Kyrgyz Republic "About the Government of the Kyrgyz Republic" the Government of the Kyrgyz Republic decides:

1. Bring in the order of the Government of the Kyrgyz Republic "About licensing of separate types of activity" of May 31, 2001 No. 260 the following change and amendment:

in Regulations on the licensing of separate types of activity approved by the above-stated resolution:

- state Chapter 25 in the following edition:

"Chapter 25 of Feature of licensing of educational activities

1. The name of the licensed type of activity: educational activities.

Educational activities are subject to licensing (except the public and local government offices of education realizing programs of the preschool, primary general, main and secondary general education).

The license permits to perform educational activities only for the directions (specialties) of preparation and the education levels specified in the license.

The license is granted to legal entities.

2. Name of the licensor: authorized state body in the field of education.

3. The license is termless and is issued without effective period.

4. For the legal entities performing educational activities (except the public and local government offices of education realizing programs of the preschool, primary general, main and secondary general education) the following additional general licensed requirements are established:

- compliance of equipment of educational process to contents of the educational program;

- compliance of qualification of pedagogical workers and completeness of states to the purposes and contents of educational programs;

- compliance of the name of the educational organization to the declared educational programs.

5. For the legal entities performing educational activities for the program of higher education the licensed requirements specified in appendix 1 to this Chapter are established.

6. For the legal entities performing educational activities for the program of secondary professional education the licensed requirements specified in appendix 2 to this Chapter are established.

7. For the legal entities performing educational activities for the program of primary professional education the licensed requirements specified in appendix 3 to this Chapter are established.

8. For the legal entities performing educational activities for the program of the secondary general education (except the public and local government offices of education realizing programs of the preschool, primary general, main and secondary general education) (1-3 steps of training), the licensed requirements specified in appendix 4 to this Chapter are established.

9. For the legal entities performing educational activities for the program of preschool education the licensed requirements specified in appendix 5 to this Chapter are established.

10. For the legal entities performing educational activities for the program of additional education the licensed requirements specified in appendix 6 to this Chapter are established.

11. Qualification examinations (certification) of teachers are not held.

12. For check of compliance of the applicant to licensed requirements the commission of experts with involvement of highly qualified specialists in the corresponding field of education, representatives of civil society and members of the public supervisory board of authorized state body in the field of education is created.

13. The onetime license fee during the licensing or renewal is levied according to the legislation on non-tax payments.

14. Additional documents for licensing on implementation of educational activities:

- the statement on conducting licensed examination (No. form 1);

- general information about structure of the educational organization, number of pupils (No. form 2);

- data on educational material resources of the educational organization (No. form 3);

- copies of the documents confirming the property right, economic maintaining or operational management by the rooms used for carrying out educational process.

For the private organizations of the preschool, initial, main and secondary general education, primary professional and additional education there is enough lease agreement for the term of at least 3 years.

For the organizations of all types lease of additional rooms, no more than the floor area on the property right, operational management or economic maintaining is allowed;

- data on security of the educational organization by library, educational literature (No. form 4);

- data on staffing of educational process (No. form 5);

- in case of use by the licensee of the equipment, stock, funds and premises of libraries, organizations of the social sphere of the state educational organizations under lease, joint activities, joint use - the relevant contract with the state educational organization.

Forms of the main additional documents are specified in appendices 7, 8 to this Chapter.";

2. To the Ministry of Education and Science of the Kyrgyz Republic to bring the regulating documents into accord with this resolution.

3. To impose control of execution of this resolution on department of education, culture and sport of Government office of the Kyrgyz Republic.

4. This resolution becomes effective not earlier than fifteen days from the date of official publication.
