About modification and amendments in some resolutions of Board of National Bank of the Republic of Belarus
Based on Article part four paragraph two 34, the Board of National Bank of the Republic of Belarus DECIDES: parts one of article 39 of the Bank code of the Republic of Belarus, subitem 3.6 of Item 3 of Article 132 and subitem 3.1 of Item 3 of article 133 of the Tax Code of the Republic of Belarus

Bring in the Instruction about procedure for forming and use by banks and non-bank credit and financial organizations of special reserves on covering of possible losses on the assets and transactions which are not reflected in balance approved by the resolution of Board of National Bank of the Republic of Belarus of September 28, 2006 No. 138 (The national register of legal acts of the Republic of Belarus, 2006, No. 184, 8/15214; 2008, No. 43, 8/18002; No. 201, 8/19322; 2009, No. 4, 8/20164; No. 240, 8/21468; 2011, No. 123, 8/24309), following changes and amendments:
1.1. in Item 3:
in part one:
in paragraph eleven "partner" shall be replaced with words the word "principal, prikazodatel or other instructing party";
the twelfth to state the paragraph in the following edition:
"the partner on contingent obligations - face who as a result of execution of contingent obligation by bank becomes:";
after the paragraph of the twelfth to add part with paragraphs of the following content:
"in cases if according to the legislation and (or) terms of the contract (agreements) obligation fulfillment before bank is unconditional and irrevocable, - the debtor of bank proceeding from terms of the contract (agreements);
in cases if several persons become debtors of bank, liable jointly and severally on obligation fulfillment before bank, - one of debtors determined by bank in the procedure established by it according to the legislation;
