The purpose of this Law is regulation of the relations in the field of protection and use of trade secret.
The legislation on trade secret consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about trade secret then are applied rules of the international treaty.
In this Law the following basic concepts are applied:
the trade secret - information having commercial value in scientific and technical, technological, production, financial and economic and other spheres owing to uncertainty to her third parties to which there is no open entry legally and the owner of this information takes measures for protection of its confidentiality;
confidentiality of trade secret - condition of trade secret in case of which its safety from leakage, disclosure and unauthorized access is ensured;
the owner of trade secret - the legal entity or physical person which is performing ownership, use and the order of trade secret and set concerning it the mode of trade secret;
the confidant - the legal entity or physical person which received in ownership and use trade secret based on the contract with her owner;
disclosure of trade secret - action or failure to act as a result of which information which is trade secret in any possible form (oral, written, other form, including with use of technical means) becomes known to the third parties without the consent of the owner of such information or the confidant or contrary to the employment contract (contract) or the civil agreement;
the mode of trade secret - system of the legal, organizational, technical and other measures limiting access to trade secret.
