About modification of some legal acts of Ukraine concerning restriction of intervention in activities of subjects of managing

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. In the Code of Ukraine about administrative offenses (The sheet of the Supreme Council of USSR, 1984, appendix to No. 51, the Art. 1122):

To add 1) with Article 166-21 of the following content:

"Article 166-21. Violation of procedure of the state supervision (control) in the field of economic activity

Violation of the procedure of actions of the state supervision (control) established by the law in the field of economic activity, namely:

violation of terms of implementation of actions of the state supervision (control);

violation of frequency of implementation of planned actions of the state supervision (control);

holding actions of the state supervision (control) in the absence of the bases established by the law;

holding planned actions of the state supervision (control) without due written notice or with violation of times for notification if need and term of the specified notification are established by the law;

holding unplanned actions of the state supervision (control) without approval of the relevant central executive body if receipt of such approval is obligatory according to the law;

implementation of actions of the state supervision (control) without application of the inspection statement, the containing list of questions for conducting check of fulfillment of requirements of the legislation in the field of economic activity;

violation of the procedure for sampling of products established by the Law of Ukraine "About the basic principles of the state supervision (control) in the field of economic activity";

conducting check of observance of requirements of the legislation, supervision (control) of which observance belongs to powers of state supervision body (control), established by the law;

promotion of requirements about provision of documents, information, product samples which are not concerning action of the state supervision (control);
