About modification of the Procedure for provision and document creation for purpose (recalculation) of pensions according to the Law of Ukraine "About obligatory national pension insurance"

According to article 44 of the Law of Ukraine "About obligatory national pension insurance" the board of the Pension fund of Ukraine DECIDES:

1. Make changes to the Procedure for provision and document creation for purpose (recalculation) of pensions according to the Law of Ukraine "About obligatory national pension insurance", the board of the Pension fund of Ukraine approved by the resolution of November 25, 2005 No. 22-1, registered Ukraine on December 27, 2005 at No. 1566/11846, having been reworded as follows it which is applied the Ministry of Justice.

2. To legal management of the Pension fund of Ukraine (Ryabtseva T. B.) submit this resolution on state registration to the Ministry of Justice of Ukraine.

3. The resolution becomes effective from the date of its official publication.

4. To impose control of execution of this resolution on the vice chairman of the board of the Pension fund of Ukraine Nikitenko V. S.

Procedure for provision and document creation for purpose (recalculation) of pensions according to the Law of Ukraine "About obligatory national pension insurance"

I. Request for purpose (recalculation) of pension

1.1. The statement for award of pension to unemployed persons, and also family members in connection with loss of the supporter moves the applicant personally or through the representative who is acting on the basis of the power of attorney issued to it certified notarially, directly in management of the Pension fund of Ukraine of the area, the city, the area in the city, and also in the city and the area (further - the body granting pension) at the place of residence (registration).

1.4. The application for award of pension by the convict to imprisonment is submitted through the representative who is acting on the basis of the power of attorney issued to it certified notarially in the body granting pension on the location of correctional facility.

At the request of specified persons the relevant documents for award of pension can be filed by them directly according to Article 122 of the Penitentiary code of Ukraine.

1.5. The statement for transfer from one type of pension into another, about recalculation of pension, about pension payment in connection with departure on the permanent residence abroad, pension payment renewals, about payment of part of pension on disabled members of the family of person which is on complete state providing about pension payment by proxy which effective period is more than one year, every other year of operation of such power of attorney moves the pensioner personally or his legal representative in the body granting pension for the location on accounting as the receiver of pension, and to pensioners who live in the territory of the Autonomous Republic of Crimea and Sevastopol and do not receive pension from authorized bodies of the Russian Federation, - in the body granting pension, determined by the Pension fund of Ukraine. The administration of correctional facility where the pensioner serves sentence, sends to body which grants pension, on the location of this starting the notification on arrival of the convict in organization and the reference of this institution with indication of details for transfer of pension.

1.6. The request for award of pension can be performed after emergence of pension entitlement or not earlier than before month before achievement of retirement age at any time.

1.7. Day of acceptance by body which grants pension, the corresponding statement is considered day of the request for award of pension.

If the statement is sent by mail (except cases of appointment (updating) of pensions), the date specified on postage stamp of the place of departure of the statement is considered day of the request for pension.

If not all necessary documents, the body granting pension are enclosed to the application for award of pension in writing notifies the applicant on what documents need to be filed in addition about what in the statement for award of pension the corresponding entry is made. If they are provided no later than three months from the date of the notification on need of submission of additional documents, then day of the request for award of pension day of reception of an application about award of pension or the date specified on postage stamp of the place of departure of the statement is considered.
