About introduction of amendments to the Law of Ukraine "About fight against terrorism" rather preventive detention around conducting anti-terrorist operation of persons involved in terrorist activities, for the term of over 72 hours

The Verkhovna Rada of Ukraine decides:

I. Introduce in the Law of Ukraine "About fight against terrorism" (Sheets of the Verkhovna Rada of Ukraine, 2003, No. 25, Art. 180 with subsequent changes) the following changes:

1. To add article 14 after part two with new part of the following content:

"For the purpose of protection of citizens, the state and society from terrorist threats around conducting long-term anti-terrorist operation as the exception, taking into account the features established by this Law can be performed preventive detention of persons involved in terrorist activities, for the term of over 72 hours, but no more than for 30 days".

With respect thereto speak rapidly third - to consider the fourth respectively parts four - heel.

2. Add with Article 15-1 of the following content:

"Article 15-1. Features of preventive detention around conducting anti-terrorist operation of persons involved in terrorist activities

For prevention of terrorist threats around conducting anti-terrorist operation according to the penal procedural legislation of Ukraine taking into account the features established by this Law preventive detention of persons involved in terrorist activities, for the term of over 72 hours can be performed.

The deadline of preventive detention cannot exceed 30 days.

The basis for preventive detention is availability of reasonable suspicion of committing by person of terrorist activities.

Preventive detention is performed according to the motivated decision of the chief of Head department (management) of the Security Service of Ukraine or the chief of Head department (management) of the Ministry of Internal Affairs of Ukraine in the Autonomous Republic of Crimea, in the respective area, the cities of Kiev and Sevastopol with the consent of the prosecutor and without resolution of the investigative judge, court.
