About entering of amendments into article 344 of the Code of the Republic of Moldova about offenses No. 218-XVI of October 24, 2008

Art. I. – Article 344 of the Code of the Republic of Moldova about offenses No. 218-XVI of October 24, 2008 (2009, Art. No. 3-6, 15), with subsequent changes, to add the official monitor of the Republic of Moldova with parts (5) and (6) the following content:

"(5) the Violation of the requirements which are relating to the conclusion and agreement performance at distance about consumer financial services, expressed in:

a) non-presentation of type of financial service to the conclusion the consumer of the agreement at distance, and also not informing it about terms and terms of the contract or not message to it the preliminary information, except as specified, provided by part (6) this Article and part (4) Article 293-2,

attracts imposing of penalty on physical persons in the amount of 10 to 25 conventional units, on officials in the amount of 50 to 100 conventional units and on legal entities in the amount of 100 to 200 conventional units;

b) to nonpayment by the supplier within 30 calendar days of the amounts received under the agreement at distance in case of withdrawal of the agreement, except for the amounts for actually provided financial service,

attracts imposing of penalty on physical persons in the amount of 25 to 75 conventional units, on officials in the amount of 75 to 150 conventional units and on legal entities in the amount of 200 to 300 conventional units;

c) use of means of remote communication, others what the automated system of challenge of the subscriber without intervention of the person (the device of automatic dialing), the device of fax connection or the fax, in case of nonrequested messages in the presence of explicit refusal of them from the consumer; or

d) to delivery to the consumer of financial service at distance for a fee without implementation of preliminary request by it if this delivery assumes immediate or subsequent payment of service,
