Based on articles 36 and 37 of the Law No. 221-XVI of October 19, 2007 on veterinary and sanitary activities (The official monitor of the Republic of Moldova, 2013, Art. No. 125-129, 396), with subsequent changes and amendments, for the purpose of transposition of requirements of Regulations No. 124/2009/EU of the Commission of the European Community of the February 10, 2009 establishing the maximum levels of presence of koktsidiostat or gistomonostat at foodstuff as a result of inevitable transfer of these substances in forages in which their application is not authorized of the European Union No. L published in the Official magazine 40 of February 11, 2009 p. 7, DECIDES: the Government

Approve:

1. The maximum levels of presence of koktsidiostat or gistomonostat at foodstuff as a result of inevitable transfer of these substances in forages, according to appendix.

2. Determine that:

1) if the foodstuff listed in appendix to this regulation contains contaminant which exceeds the limits provided in appendix they shall not accommodate in the market, and in case of detection of significant amount of waste it is lower than the level, established in appendix, the National agency on safety of foodstuff shall conduct researches for confirmation that waste is present as a result of inevitable transfer in foodstuff, but not owing to illegal application of koktsidiostat or gistomonostat;

2) foodstuff which corresponds to the levels established in appendix should not be mixed with foodstuff which exceeds these levels.

3. In case of use of the levels specified in appendix to this regulation for the dry foodstuff diluted, processed or consisting from more than one ingredient consider changes of concentration of contaminant owing to drying, dilution or processing, and also relative share of ingredients in product.
