About conditions of application of the concept "industrial assembly of motor vehicles" in the territories of state members of the Customs union and the Common economic space

For the purpose of forming of the conditions promoting creation and effective development in state members of the Customs union and the Common economic space of industrial assembly productions in automotive industry (further - car assembly productions), and having taken into consideration information of the Eurasian economic commission, the Supreme Eurasian economic council at the level of heads of states solved:

1. To state members of the Customs union and the Common economic space (further - state members) within 90 calendar days from the effective date this Decision to provide fixing in the legislation:

1) conditions of application of the concept "industrial assembly of motor vehicles" on the list according to appendix for car assembly productions when importing to single customs area of the Customs union of the goods classified by codes of the single Commodity nomenclature of foreign economic activity of the Customs union (further - FEACN CU) for "industrial assembly";

2) deadline of operation of agreements between authorized bodies of state members and legal entities of state members about industrial assembly of motor vehicles (further - agreements) - on December 31, 2020;

3) possibilities of use of the following measures for non-compliance with conditions of application of the concept "industrial assembly of motor vehicles":

for failure to carry out of terms of agreement - suspension of operation of the agreement before accomplishment of its requirements;

for inappropriate use of the goods imported on single customs area of the Customs union using the FEACN CU codes for "industrial assembly" - payment of difference in duties on the goods used not for designated purpose;
