About introduction of amendments to some laws of Ukraine on reforming of management system the Single gas-transport system of Ukraine

For the purpose of reduction of functioning of gas-transport system of Ukraine in compliance with the obligations undertaken by Ukraine within the Constitutive treaty of Energy Community, in particular concerning requirements of the Directive 2009/73/EU of the European Parliament and Council of the European Union of rather general rules for the domestic market of natural gas and the Regulations 715/2009 European Parliament and the Council of the European Union about conditions of access to networks of transfer of natural gas, the Verkhovna Rada of Ukraine decides:

I. Make changes to the following laws of Ukraine:

1. Part the second article 4 of the Law of Ukraine "About lease of the state-owned and utility property" (Sheets of the Verkhovna Rada of Ukraine, 1995, No. 15, Art. 99; 1998, No. 49, Art. 301; 2004, No. 50, Art. 539; 2006, No. 8, Art. 89; 2009, No. 8, Art. 105; 2011, No. 4, Art. 22, No. 44, Art. 458; 2013, No. 7, Art. 65, No. 41, Art. 550; 2014, 717) to add Art. No. 20-21, with the paragraph the twenty fourth the following content:

"The restrictions set by this Article do not extend to transfer to lease of state-owned property as a part of trunk gas pipelines and underground gas storages, entering the Single gas-transport system of Ukraine, to the company or the companies on urgent paid basis without the alienation right for implementation of functions of the operator of the Single gas-transport system of Ukraine and/or the operator of underground gas storage. The specified cession of property in lease can be performed only with the purpose and in obligation fulfillment, taken by Ukraine according to the Law of Ukraine "About ratification of the Protocol on accession of Ukraine to the Constitutive treaty of Energy Community" based on the agreement and on the conditions approved by the Cabinet of Ministers of Ukraine taking into account the principles of observance of economic safety of the state".
