Article 1. Bring in the Civil code of the Republic of Belarus of December 7, 1998 (Vedamastsi Natsyyanalnaga to descent of Respubliki Belarus, 1999, No. 7-9, of Art. 101; National register of legal acts of the Republic of Belarus, 2006, No. 122, 2/1257; National legal Internet portal of the Republic of Belarus, 17.07. 2012, 2/1940) following amendments and changes:
1. To add Item 1 of Article 317 with part three of the following content:
"By legal acts other transfer restrictions of property as a deposit can be set.".
2. Article 596 after the words "finance lease" to add with the word "(leasing)".
3. State Article 636 in the following edition:
"Article 636. Agreement of finance lease (leasing)
Under the agreement of finance lease (leasing) (further - the agreement of finance lease) the lessor (lessor) who is the legal entity or the individual entrepreneur shall acquire in property the property specified by the lessee (leasing recipient) at the seller (supplier) determined by it and provide to the lessee (leasing recipient) this property constituting the subject of the agreement of finance lease, for a fee in temporary ownership and use. The lessor (lessor) in this case does not bear responsibility for the choice of the subject of the agreement of finance lease and the seller (supplier).
The agreement of finance lease can provide that the choice of the seller (supplier) and acquired property is performed by the lessor (lessor).
The lessee (leasing recipient) can act as the seller (supplier) of the property transferred to it as the subject of the agreement of finance lease.
