About introduction of amendments to some acts of the Government of the Russian Federation concerning stimulation of use of renewable energy resources in the retail markets of electrical energy

The government of the Russian Federation decides:

1. Approve the enclosed changes which are made to acts of the Government of the Russian Federation concerning stimulation of use of renewable energy resources in the retail markets of electrical energy.

2. To Federal Tariff Service in 4-month time: approve methodical instructions for price fixation (rates) and (or) limiting (minimum and (or) maximum) price levels (rates) for the electrical energy (capacity) made on the qualified generating objects functioning on the basis of use of renewable energy resources and acquired for the purpose of compensation of losses in power networks;

bring the regulatory legal acts into accord with this resolution.

Changes which are made to acts of the Government of the Russian Federation concerning stimulation of use of renewable energy resources in the retail markets of electrical energy

1. In standards of disclosure of information by subjects wholesale and the retail markets of electrical energy approved by the order of the Government of the Russian Federation of January 21, 2004 No. 24 "About approval of standards of disclosure of information by subjects wholesale and the retail markets of electrical energy" (The Russian Federation Code, 2004, No. 4, Art. 282; 2009, No. 17, Art. 2088; 2010, No. 33, Art. 4431; 2011, No. 45, Art. 6404; 2012, No. 4, Art. 505; No. 23, Art. 3008; 2013, No. 27, Art. 3602; No. 31, Art. 4216, 4226; No. 36, Art. 4586; No. 50, Art. 6598; 2014, No. 8, Art. 815; No. 9, Art. 907, 919; No. 19, Art. 2416; No. 25, Art. 3311):

a) add Item 11 with the subitem "m" of the following content:

"l) about amount and cost of electrical energy (capacity) for settlement period acquired according to each purchase and sale agreement (delivery) of electrical energy (capacity) for the purpose of compensation of losses of electrical energy concluded with the electric power producer (capacity) in the retail market of electrical energy performing production of electrical energy (capacity) on the qualified generating objects functioning on the basis of use of renewable energy resources which amounts are confirmed with the certificate issued by Market Council with indication of the name of such producer.";

b) in paragraph three of Item 12 of the word "the paragraph the eighteenth the subitem "b" of Item 11" shall be replaced with words "the paragraph the eighteenth the subitem "b" and the subitem "m" of Item 11";

c) add Item 22 with the subitem "zh" of the following content:

"g) about hourly sales amounts of electrical energy (capacity) made on each qualified generating object which points of delivery are located in zone of activities of the guaranteeing supplier, according to each purchase and sale agreement (delivery) of electrical energy (capacity) for the purpose of compensation of losses concluded with the electric power producer (capacity) in the retail market of electrical energy performing production of electrical energy (capacity) on the qualified generating objects functioning on the basis of use of renewable energy resources which amounts are confirmed with the certificate issued by Market Council with indication of the name of the corresponding electric power producer (capacity) and the network organization which signed the specified agreement.";

d) add Item 22 with the paragraph of the following content:

"Information specified in the subitem "zh" of Item 22 of this document is subject to publication by the guaranteeing suppliers in the terms provided by Basic provisions of functioning of the retail markets of electrical energy, but at least once a month.".

2. The rules of development and approval of schemes and programs of perspective development of power industry approved by the order of the Government of the Russian Federation of October 17, 2009 No. 823 "About schemes and programs of perspective development of power industry" (The Russian Federation Code, 2009, No. 43, Art. 5073; 2013, No. 33, Art. 4392; 2014, No. 9, of the Art. 907) to add with Item 28 (1) the following content:

"28(1). Inclusion of the generating object functioning on the basis of use of renewable energy resources concerning which sale of electrical energy (capacity) is planned in the retail markets in the scheme of development of power industry of the region is performed in case of respect for the following principles:

minimization of increase in prices (rates) for electrical energy (capacity) for final consumers of the retail market of electrical energy (capacity);

in the territories of the subjects of the Russian Federation united in price and not price zones of the wholesale market, except for the territories which are technologically not connected with Power pool system of Russia and technologically isolated territorial electric utility systems - not excess of cumulative forecast production volume of electrical energy (capacity) by the qualified generating objects functioning on the basis of use of renewable energy resources in the retail market of electrical energy, and also the generating objects functioning on the basis of use of renewable energy resources concerning which sale of electrical energy (capacity) is planned in the retail market of electrical energy which are included in the scheme of development of power industry of the region or concerning which the question of their inclusion in the scheme of development of power industry of the region, over size is considered, to equal 5 percent of cumulative forecast amount of losses of electrical energy (capacity) of the territorial network organizations functioning in the subject of the Russian Federation, the production determined in the composite balance estimation and deliveries of electrical energy (capacity) within Power pool system of Russia on subjects of the Russian Federation;

in the territories of the subjects of the Russian Federation included in the list of technologically isolated territorial electric utility systems and in the territories which are technologically not connected with Power pool system of Russia and technologically isolated territorial electric utility systems, decrease as a result of implementation of the investment project of cost of electrical energy (capacity) in the corresponding territory;

minimization of ecological damage;

the solution of social tasks in the territory of implementation of the investment project;

publicity and openness.

Inclusion of the generating object functioning on the basis of use of renewable energy resources concerning which sale of electrical energy (capacity) is planned in the retail markets in the scheme of development of power industry of the region is performed on competitive basis.

The procedure and conditions of carrying out competitive selections on inclusion of the generating objects functioning on the basis of use of renewable energy resources concerning which sale of electrical energy (capacity) is planned in the retail markets in the scheme of development of power industry of the region and also requirements to the corresponding investment projects and criteria of their selection are established by executive bodies of subjects of the Russian Federation with respect for the principles specified in this Item.

When holding competitive procedures in case of selection of projects of the generating facilities for production of electrical energy (capacity) with use of renewable energy resources shall be provided:

respect for the principles of inclusion of the generating objects functioning on the basis of use of renewable energy resources concerning which sale of electrical energy (capacity) is planned in the retail markets, in the scheme of development of power industry of the region;

publicity of conditions and requirements for holding competitive procedures of selection of projects, including publicity of data on term, the place and procedure for provision of the tender documentation, requirements to form and structure of the bid by publication in printing editions in which according to the laws of subjects of the Russian Federation official materials of public authorities of subjects of the Russian Federation, and also placements on the official site of the subject of the Russian Federation are published in the Internet not later than 30 days about day of carrying out competitive selection in time;
