Due to the origin in court practice of questions on application of the Law of Ukraine "About recovery of solvency of the debtor or recognition by his bankrupt" (in edition of the Law of Ukraine of 22.12.2011 No. 4212-VI) the Supreme Economic Court of Ukraine considers necessary to make such changes to Items 10, 33 Information letters of the Supreme Economic Court of Ukraine of 28.03.2013 No. 01-06/606/2013 "About the Law of Ukraine "About recovery of solvency of the debtor or recognition by his bankrupt" (in edition of the Law of Ukraine of 22.12.2011 No. 4212-VI)":

1. The fourth Item 10 to state the paragraph in the following edition:

"As automatic selection of the candidate for the external managing director for cases on bankruptcy is performed proceeding from coefficient of complexity of case which is determined taking into account pattern of ownership and form of business of the debtor, the extract from the Unified State Register of Legal Entities and physical persons - entrepreneurs (further - the Unified state register) concerning the debtor is enclosed to the application for initiation of proceedings for bankruptcy. However, non-presentation of such statement does not involve return of the statement for initiation of proceedings about bankruptcy without consideration; in that case the economic court will request from it the applicant according to the procedure of preparation of case for consideration (Article 65 GPK).
