The government of the Republic of Belarus and the Cabinet of Ministers of Ukraine which are referred to as further the Party

realizing that protection and rational use of waters, protection against harmful effects of waters are important and pressing tasks which effective solution can be provided only by close cooperation and the approved water management and water preserving activities,

wishing to resolve issues of water economy on cross-border waters in the spirit of neighborliness, cooperation and mutual advantage,

emphasizing need of national and international measures for the prevention and restriction of dumpings of hazardous substances on water environment, to rational use of waters, preserving water resources,

considering the basic principles of the Convention on protection and use of cross-border water currents and the international lakes of 1992 and based on the national legal system of the states of the Parties,

agreed as follows:

Article 1 of Determination

"Cross-border waters" or "cross-border water objects" - any surface or underground water or water objects which designate or cross frontier between the states of the Parties or are located on such border.

"Cross-border impact" - means any considerable harmful effects resulting from change of the condition of cross-border waters caused by activities of the person which physical source is located fully or partially in the area which is under jurisdiction of the state of this or that Party.

"Authorized bodies" - the ministry or other state body on which the decision of the Government confers responsibility for the organization of accomplishment of this agreement.

"Competent authorities" - the ministries or other state bodies which competence includes accomplishment of separate work types on accomplishment of this agreement.
