The government of the Russian Federation and the Cabinet of Ministers of Ukraine which further are referred to as with the Parties

based on regulations of the Contract between the Russian Federation and Ukraine on economic cooperation for 1998-2007 of February 27, 1998 and the Agreement between the Government of the Russian Federation and the Government of Ukraine on cooperation in development of fuel and energy complexes of September 7, 1994,

proceeding from interest in development and deepening of further mutually beneficial cooperation in the field of transit of oil across the territory of Ukraine,

agreed as follows:

Article 1

The parties on the basis of mutual advantage and taking into account economic interests cooperate in area of transit of the oil arriving from the territory of the Russian Federation for the third countries through the territory of Ukraine pipeline transport.

Article 2

The Ukrainian Side provides transit of oil across the territory of Ukraine on trunk oil pipeline system taking into account their handling capacities.

The Ukrainian Side through the competent authority annually informs the Russian Side on handling capacities of trunk oil pipelines of Ukraine.

Article 3

The Russian side when forming oil transportation schedules out of limits of customs area of the Russian Federation will consider the handling capacities of system of pipeline transport of Ukraine declared by the Ukrainian Side.

Transit of oil is performed based on service provision agreements between authorized organizations of the Parties, and also contracts between authorized organization of the Russian Side and consignors of oil in the amounts determined by the oil transportation schedules approved by the Russian Side in accordance with the established procedure.

Amounts and the directions of transit of oil across the territory of Ukraine are specified by the annual protocols signed by competent authorities of the Parties.
