Approve the enclosed changes which are made to the order of the Government of the Russian Federation of November 1, 2008 No. 803 "About approval of Rules of provision of the state guarantees of the Russian Federation in foreign currency for rendering the state support of export of industrial output (goods, works, services) (The Russian Federation Code, 2008, No. 46, Art. 5331; No. 51, Art. 6174; 2010, No. 48, Art. 6400; 2013, No. 8, Art. 843; 2014, No. 13, Art. 1487).

Changes which are made to the Order of the Government of the Russian Federation of November 1, 2008 No. 803

1. Add with Item 5 of the following content:

"5. The "Development Bank and Foreign Economic Activity (Vnesheconombank)" state corporation to perform functions of the agent of the Government of the Russian Federation concerning provision and execution of the state guarantees of the Russian Federation provided for rendering the state support of export of industrial output (goods, works, services) including concerning conducting analytics of the state guarantees of the Russian Federation, obligations of principal, his guarantors (guarantors) and other persons in connection with provision and execution of the state guarantees of the Russian Federation, and also concerning financial analysis and debt collection of specified persons.".

2. In Rules of provision of the state guarantees of the Russian Federation in foreign currency for rendering the state support of export of industrial output (goods, works, services) approved by the specified resolution:

1) in Item 1:

in the subitem "b" of the word "" shall be replaced with words the agent of the Government of the Russian Federation concerning ensuring the state support of export of industrial output (further - agent bank) "The national specialized Russian export-import bank (joint-stock company) (further - the ROSEKSIMBANK joint-stock company)";

in subitems "v" - "д" words "agent bank" in the corresponding case shall be replaced with words "ROSEKSIMBANK joint-stock company" in the corresponding case;

To add 2) with Item 6 (1) the following content:

"6(1). The state guarantees are provided on condition of satisfactory financial condition of principal.

If the principal is the Russian legal entity, the satisfactory financial condition is confirmed by the agent involved by the Government of the Russian Federation according to the Federal Law on the federal budget for the corresponding financial year and for planning period to implementation of functions of the agent of the Government of the Russian Federation concerning provision and execution of the state guarantees of the Russian Federation (further - the agent of the Government of the Russian Federation).

If the principal is the foreign legal entity, the financial condition is recognized satisfactory with the credit rating testimonial of satisfactory financial condition, and also the cases specified in the subitem "g" of Item 12 and subitems "v" - "е" Item 13 of these rules.

If principal is the foreign state, the financial condition is recognized satisfactory the cases specified in Item 8 and subitems "an" and "b" of Item 13 of these rules.";

3) Item 8 (to add 1) with the subitem "v" of the following content:

20. The agent of the Government of the Russian Federation within 15 working days from the date of receipt of complete set of the documents submitted according to Item 18 of these rules:

a) based on negative results of the these rules of checks and the analysis which are carried out according to Item 19 prepares and sends the motivated conclusion about failure to carry out of the conditions of provision of the state guarantee established by these rules to the Ministry of Finance of the Russian Federation, and also informs on the specified results of principal;

b) based on positive results of the these rules of checks and the analysis which are carried out according to Item 19 prepares and sends to the Ministry of Finance of the Russian Federation the conclusion containing unambiguous conclusions about possibility of decision making about provision of the state guarantee and other conclusions of the agent of the Government of the Russian Federation specified in subitems "zh" - "and" Item 13 of these rules.";
