For the purpose of determination of conditions and procedure for attraction to subsidiary responsibility of the Republic of Belarus according to the obligations of "Development Bank of the Republic of Belarus" open joint stock company arising in connection with issue, the address and repayment of its bonds:
1. Determine that:
1.1. subsidiary responsibility of the Republic of Belarus on satisfaction of requirements of the legal entity or physical person which acquired bonds of "Development Bank of the Republic of Belarus" open joint stock company (further - the investor), on repayment of nominal value of these bonds and (or) payment of the income for them comes in case of insufficiency of money * this joint-stock company (further - Development bank);

* For the purposes of this Decree money of Development bank is understood as the money which is available at its order including being on accounts in National Bank and banks placed in the quick assets determined by National Bank for calculation of standard rates of safe functioning of banks and non-bank credit and financial organizations.
1.2. the body acting on behalf of the Republic of Belarus in case of approach of subsidiary responsibility according to obligations of Development bank is the Council of Ministers of the Republic of Belarus;
1.3. subsidiary responsibility of the Republic of Belarus does not extend to obligations according to the redemption Development bank of bonds of own issue before the term of their repayment, except as specified, when such obligations are provided by bond issue conditions and also when the decision on reorganization or liquidation of Development bank is made or concerning Development bank economic court insolvency proceedings or bankruptcy are initiated;
