Regulations on the Appeal patent commission

I. General provisions

1.1 This Provision is developed according to the Patent Legislation of Turkmenistan and determines procedure for creation and activities of the Appeal patent commission (further - the Commission).

1.2 The purpose of creation of the Commission is consideration of objections and statements of legal entities and physical persons for the violated or disputed rights according to the Patent Legislation of Turkmenistan.

1.3 The commission performs the activities as collegiate organ of Patent management of the Ministry of Economics and finance of Turkmenistan (further Patent management).

1.4 The commission in the activities is guided:

a) Constitution of Turkmenistan;

b) Civil code of Turkmenistan of Saparmurat Turkmenbasha;

c) Patent legislation of Turkmenistan;

d) Other laws and regulatory legal acts of Turkmenistan;

e) international conventions, contracts and agreements in the field of protection of objects of industrial property which participant is Turkmenistan and if these documents establish other rules than containing in this Provision then apply regulations of international conventions, contracts and agreements;

d) this provision and regulating documents of Patent Management;

e) this Provision.

1.5 The basic concepts applied in this Provision:

"appeal" - the written objection or the application submitted to the Commission against the solution of Patent management on the request for issue of the security document for object of industrial property or the international registration of sign or against issue of the security document or distribution of action of the international registration of sign for the territory of Turkmenistan;

"statement" - the written application submitted to the Commission on question of provision of the compulsory license for use of the invention or industrial design or to other questions including the field of activity of the commission;
