About introduction of amendments to some laws of Ukraine concerning refining of powers of notaries and features of registration of the derivative rights to the parcels of land of agricultural purpose

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following laws of Ukraine:

1. In the Law of Ukraine "About notariate" (Sheets of the Verkhovna Rada of Ukraine, 1993, No. 39, Art. 383; 2013, No. 23, Art. 224, No. 33, Art. 436; 2014, Art. No. 23 876):

Part one of Article 3 to add 1) with words "and also performs functions of the state registrar of the rights to real estate according to the procedure and the cases established by the Law of Ukraine "About state registration of the rights to real estate and their encumbrances";

2) in Article 46-1:

the second after words "object of construction in progress" to add part with the words "and when implementing functions of the state registrar of the rights to real estate";

third to state part in the following edition:

"Use of the State register of the rights to real estate is performed directly by the notary who makes the corresponding notarial action and/or performs state registration of the rights to real estate and their encumbrances";

add with parts four - the sixth the following content:

"The notary when making notarial actions and/or when implementing state registration of the rights to real estate concerning the parcel of land has access and uses the State land cadastre according to the procedure, established by the Cabinet of Ministers of Ukraine.

The notary when making notarial actions concerning the parcel of land (except the certificate of the will) and/or when implementing state registration of the rights to the parcel of land performs search in the State land cadastre of data on the registered parcel of land and by its results by means of the software of the State land cadastre creates the statement of the State land cadastre about the parcel of land which signs and assures notary's seal. Extraction remains in office of notary public or the private notary.
