About entering of amendments into the Code of administrative legal proceedings of the Republic of Armenia

Article 1. Of December 5, 2013 to add part 2 of article 3 of the Code of administrative legal proceedings of the Republic of Armenia (further – the Code) with Item 2.1 of the following content:

"2. 1) with the requirement about collection from physical person or legal entity of the amount provided by public monetary claims based on the neoprotestuyemy administrative act;".

Article 2. To add the Section V of the Code with Chapter 29.1 of the following content:

"Chapter 29.1. Production on cases on collection of the amount on public monetary claims based on the neoprotestuyemy administrative act

Article 216.1. Cases on collection of the amount on public monetary claims based on neoprotestuyemy court resolutions

1. Cases on collection of the amount on public requirements based on neoprotestuyemy court resolutions (further – proceedings on collection) are initiated on the bases provided by part 1.1 of article 88 of the Law of the Republic of Armenia "About bases of administration and administrative production" - based on the action for declaration of the administrative authority which adopted this act.

2. The action for declaration on cases on collection can be submitted to Administrative court:

1) in three-months time since the moment when the administrative act becomes neoprotestuyemy;

2) in two-month time from the moment of completion by the police officer of enforcement proceeding on public monetary claim.

3. The Neoprotestuyemost of this administrative act is cancelled by determination of Administrative court about acceptance to production of the action for declaration on cases on collection.

Article 216.2. Requirements imposed to the action for declaration on cases on collection

1. In addition to requirements imposed by Article 73 of this Code, the action for declaration on cases on collection includes also data:

1) about entry into force and neoprotestuyemost of the administrative act,
