About modification and amendments in the Code of television and radio of the Republic of Moldova No. 260-XVI of July 27, 2006

The Parliament adopts this organic law.

Art. I. – In the Code of television and radio of the Republic of Moldova No. 260-XVI of July 27, 2006 (Official monitor of the Republic of Moldova, 2006, Art. No. 131-133, 679), with subsequent changes, to make the following changes and additions:

1. Add Article 2 with Items x) and y) the following content:

"x) control – opportunity to exert decisive impact on the legal entity as it is stipulated in Article 4 Competition acts No. 183 of July 11, 2012, following from the rights, agreements or any other tools separate or combined, taking into account the corresponding legal and actual circumstances, in particular from:

– property rights or rights to complete or partial use of assets of the legal entity;

– the rights or agreements which allow to exert the solving impact on structure, vote or decisions of governing bodies of the legal entity.

Control is acquired by physical persons or legal entities which are owners or users of the rights acquired as a result of the conclusion of the relevant agreements or which, though are not owners or users specified is right, have the right to perform following from this right;

y) the beneficial owner – physical person which based on the law and/or the agreement is in one or several of following provisions:

– receives or can receive any kind of the income from activities of the broadcasting organization or the distributor of programs and shall not transfer this income to the third party;

– has directly or indirectly, through affiliates in sense of article 6 of the Law on the capital market No. 171 of July 11, 2012, control over the broadcasting organization or the distributor of programs;
