Plenipotentiaries of the Republic of Kazakhstan and Georgia concluded the this Protocol as follows:

Article 1

Withdrawals, stipulated in Article 2 Agreements between the Government of the Republic of Kazakhstan and the Government of Georgia on free trade of November "11", 1997 extend to the goods exported from Georgia to the Republic of Kazakhstan according to Appendix No. 1.

The inventory, exported from the Republic of Kazakhstan to Georgia, the Georgian Side will be determined if necessary.

Article 2

1. Concerning goods to which withdrawals from free trade regime according to Article of 1 this Protocol extend the Parties provide each other most favored nation treatment in that, as for:

- the taxes and fees levied when exporting (concerning the goods listed in Appendix No. 1) including methods of collection of such taxes and fees;

- the provisions concerning customs clearance of transit, transportation, warehousing, overload and other similar services;

- payment methods and payment transfer;

- issues of import licenses;

- the rules concerning sale, purchase, transportation, distribution and use of goods in the domestic market.

2. Provisions of Item 1 of this Article are not applied to:

- to the benefits provided to the either party to the third countries for the purpose of creation of the Customs union or the free trade area or as a result of creation of such union or zone;

- to the benefits provided to developing countries according to the legislation of the Parties;

- to the benefits provided to neighboring countries for the purpose of simplification of border trade;

- to the benefits provided by the Parties each other according to special agreements.
