About introduction of amendments to the Tax Code of Ukraine concerning the taxation of income gained by nonresidents on debt obligations

The Verkhovna Rada of Ukraine decides:

1. Bring in the Tax code of Ukraine (Sheets of the Verkhovna Rada of Ukraine, 2011, Art. No. 13-17, 112) the following changes:

Item 141.4 of Article 141 to add 1) with subitem 141.4.10 of the following content:

"141.4.10. Income gained by nonresidents in the form of percent or the income (discount) on the government securities or bonds of local loans, or the debt securities according to which obligation fulfillment is provided with the state or local guarantees sold or placed to nonresidents outside the territory of Ukraine through authorized agents of nonresidents, or the percent paid to nonresidents for received by the state or in the budget of the Autonomous Republic of Crimea or the city budget of the loan (the credits or external borrowings) which are displayed in the Government budget of Ukraine or local budgets or the estimate of the National Bank of Ukraine, or for the credits (loans) obtained by subjects of managing and which accomplishment is provided with the state or local guarantees is not subject to the taxation";

To add 2) in subitem 165.1.2 of Item 165.1 of article 165 after words of National Bank of Ukraine with the words "and also the amount of income gained by nonresidents in the form of the percent added on government securities or bonds of local loans, or debt securities, accomplishment of obligations according to which is provided with the state or local guarantees, if such securities are acquired by nonresidents outside the territory of Ukraine through authorized agents-nonresidents, or the percent received by nonresidents for the loans (the credits or external borrowings) provided to the state or the budget of the Autonomous Republic of Crimea or the city budget which are reflected in the Government budget of Ukraine or local budgets or the estimate of the National Bank of Ukraine, or for the loans (loans) granted to subjects of managing which accomplishment is provided with the state or local guarantees".
