About modification and amendments in the Law on administrative court No. 793-XIV of February 10, 2000

The Parliament adopts this organic law.

In the Law on administrative court No. 793-XIV of February 10, 2000 (repeated publication: The official monitor of the Republic of Moldova, special release of October 3, 2006), with subsequent changes to make the following changes and additions:

1. Item e) Article 4 to declare invalid.

2. Part (Article 21 after the words "it cannot be suspended" to add 3) with the words "execution of administrative acts, stipulated in Article 24-1, and also".

3. Add the law with Article 24-1 of the following content:

"Article 24-1. Control of legality of the edition of administrative acts in emergency situations

In case of the edition of the administrative acts concerning homeland security of the Republic of Moldova, implementation of emergency rule, acceptance by bodies of the public power of emergency measures for the purpose of disaster management, the fires, epidemics, epizooty and other similar phenomena, the appeal to degree of jurisdiction is admissible only for control of the following circumstances:

a) availability of emergency situation on the date of the publication of the act;

b) competence of the body which issued the act;

c) availability of the public concerns justifying the edition of the administrative act;

d) absence at body of the public power of real opportunity to issue the act in usual conditions.".
