About introduction of amendments and changes in the Code of penal procedure of the Republic of Armenia

Article 1.  To add Article 6 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code) with Items 38.1 and 38.2 of the following content:

"38. 1) temporary arrest – content of person in bondage for the purpose of receipt of the petition for transfer and clarification of the circumstances excluding transfer;

38. 2) arrest for transfer – content of person in bondage for the purpose of ensuring its transfer;".

Article 2. Add the code with Articles 478.1-478.4 of the following content:

"Article 478.1. Procedure for detention of persons who committed crime outside the territory of the Republic of Armenia

1. In case of detention in the territory of the Republic of Armenia of persons who committed crime outside the territory of the Republic of Armenia, the body which performed detention instantly notifies the initiator of search, requiring the resolution or sentence on election of the arrest as measure of restraint which is taken out by authorized body of this state.

2. The protocol on detention of person together with necessary documents instantly goes to the Prosecutor General's Office of the Republic of Armenia.

3. The Prosecutor General's Office of the Republic of Armenia after receipt of the protocol instantly notifies authorized bodies of the state which put on the international wanted list and (or) the Ministry of Foreign Affairs of the Republic of Armenia on detention.

4. If within 72 hours from the moment of detention of person the court order of the Republic of Armenia about temporary arrest was not issued, then the detained person is subject to immediate release.
