About modification and amendments in the Code of penal procedure of the Republic of Armenia

Article 1. To add part 2 of Article 52 of the Code of penal procedure of the Republic of Armenia (on July 1, 1998, further - the Code) with new paragraphs of the following content:

"If the convict in three-months time does not take a legal action for the purpose of review of court resolution after entry into force of the law canceling crime of the act commuting penalty or improving otherwise situation of person who committed crime, then the prosecutor, after the expiration of three-months term, during monthly term brings the corresponding petition into court.

For the purpose of review of the court resolutions which are not reviewed judicially concerning persons who are earlier condemned on capital punishment, the prosecutor brings into court the corresponding petition till August 1, 2006".

Article 2. In Article 374 and in part four of article 427 of the Code of the word "not having communication with imprisonment" shall be replaced with words "not connected with imprisonment".

Article 3. The fourth article 438 of the Code after the word "representative" to add part with words "which represents to court the written characteristic about the convict issued by administration of correctional facility or command of disciplinary battalion".

Article 4. This law becomes effective for the tenth day after official publication.
