About modification and amendments in the Code of penal procedure of the Republic of Armenia

Article 1. In Article 6 of the Code of penal procedure of the Republic of Armenia (on July 1, 1998, further - the Code):

a) state Item 25 in the following edition:

"25) the investigator – the official of prosecutor's office, police, military police, homeland security, tax or customs authorities who within the powers holds pretrial investigation on case";

b) in Item 26 of the word of "internal affairs and homeland security" shall be replaced with words "prosecutor's offices, polices, military police, homeland security, tax or customs".

Article 2. To exclude the word of "prosecutor's office" from Item 25 of article 6 of the Code.

Article 3. To add part one of article 35 of the Code with part 1.1 following of content:

"1.1. Item 10 parts one of this Article do not extend to cases of recognition of person by the dead according to the procedure, provided by the Civil Procedure Code. According to the procedure, provided by the Civil Procedure Code, recognition of person by the dead is the basis for the termination concerning person of criminal prosecution and cessation of production of criminal case only according to the decision of the Attorney-General of the Republic of Armenia".

Article 4. In article 52 of the Code:

a) state part 3 in the following edition:

"3. When implementing the power on production of criminal case the prosecutor makes decisions independently, based on the laws and internal belief, and is responsible for the made decisions";

b) add with parts 4 and 5 of the following content:
