About modification and amendments in the Code of penal procedure of the Republic of Armenia

Article 1. To state Article 426.1 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code) in the following edition:

"Article 426.1. The court reviewing court resolution on again opened or new circumstances

1. Only the court resolution which took legal effect is subject to review on again opened or new circumstances.

2. The court resolution of Trial Court on again opened or new circumstances reviews Appeal Court, and court resolutions of Appeal and Cassation courts – Court of cassation".

Article 2. To state article 426.2 of the Code in the following edition:

"Article 426.2. Persons having the right of submission of the claim to review of court resolution on again opened or new circumstances

Have the right of submission of the claim to review of court resolution on again opened or new circumstances:

1) the interested persons connected with this circumstance participating in case;

2) those persons who concerning constitutionality of provision of the law on the date of adoption of the resolution of the Constitutional court had this right to sales opportunity according to requirements (terms) of the Law of the Republic of Armenia "About the Constitutional court" or owing to Items 3 or 5 of article 32 of the same law were deprived of possibility of consideration of their case in the Constitutional court;

3) those persons who at the time of the removal by international court operating with the participation of the Republic of Armenia, the corresponding court resolution had the right to the appeal to international court according to requirements (terms) of the international treaty;

4) Attorney-General of the Republic of Armenia and his deputies".

Article 3. In article 426.4 of the Code:

a) to add Item 1 of part 1 with the words "completely or by one part";

b) to state Item 2 of part 1 in the following edition:
