About modification of the Code of penal procedure of the Republic of Armenia

Article 1. To state Item 1 of part 1 of Article 426.4 of the Code of penal procedure of the Republic of Armenia of July 1, 1998 (further - the Code) in the following edition:

"1) the Constitutional court of the Republic of Armenia recognized the law provision applied by the court on this criminal case contradicting the Constitution and nullified it or corresponding to the Constitution, however in final part of the resolution, having opened its constitutional and legal content, found that this provision was applied in other interpretation".

Article 2. To state article 426.9 of the Code in the following edition:

"Article 426.9. Review of court resolutions

1. On the initiated production based on the opened again or new circumstances the court, as a result of consideration of the case, takes out court resolution in the general procedure provided by this Code.

2. In the court resolution which is taken out as a result of this production, the court can not change final part of the reviewed court resolution, only if proves with indication of powerful arguments that the circumstances provided by Articles 426.3 or 426.4 of this Code could not affect in essence the outcome of the case.

3. The court resolution of Appeal Court can be appealed in Court of cassation in the general procedure provided by the law".

Article 3. This law becomes effective for the tenth day after official publication.
