About introduction of amendments to some laws of Ukraine concerning providing competitive conditions of production of the electric power from alternative energy sources

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following laws of Ukraine:

1. In the Law of Ukraine "About power industry" (Sheets of the Verkhovna Rada of Ukraine, 1998, No. 1, Art. 1 with subsequent changes):

1) in Article 1:

after paragraph two to add with the new paragraph of the following content:

"Production of elements of the equipment of power generation facility - the activities connected with production which include accomplishment of sufficient level of production and technological operations by results of which the classification code of goods according to UKT foreign trade activities at the level of any of the first four signs changes at the same time the transactions performed in production process shall not be simple assembly transactions according to provisions of the customs legislation. The bearing designs of finished goods shall be made in Ukraine with acquisition of the status of origin from Ukraine".

With respect thereto third - the fifty fourth to consider paragraphs respectively paragraphs the fourth - the fifty fifth;

in the paragraph the forty second "body" to replace the word with the word "subject";

2) in Article 12:

third parts two to exclude the paragraph;

the third and fourth to exclude parts;

3) in Article 15:

a) the fifth and sixth to state parts in the following edition:

"The wholesale market of electrical energy of Ukraine in each settlement period shall buy from subjects of managing which establishes "green" rate and to perform complete payment of cost of the electrical energy made on power generation facilities from alternative energy sources (except the domain and coked gases, and with hydraulic power use - only micro, mini-and small hydroelectric power stations), on "green" rate taking into account the allowance to it established according to Article 17-3 - this Law, irrespective of the size of installed capacity or amounts of its leave. At the same time in each settlement period (month) the amount of leave of the electrical energy made on power generation facility from alternative energy sources (except the domain and coked gases, and with hydraulic power use - only micro, mini-and small hydroelectric power stations), is determined less amount of expenses of electrical energy for own needs in electrical energy of the relevant power generation facility making electrical energy from alternative energy sources (except the domain and coked gases, and with hydraulic power use - only micro, mini-and small hydroelectric power stations). The procedure for purchase and calculations for the electrical energy made on power generation facilities from alternative energy sources (except the domain and coked gases, and with hydraulic power use - only micro, mini-and small hydroelectric power stations), on "green" rate taking into account the allowance to it established according to article 17-3 of this Law, the wholesale market of electrical energy of Ukraine, and also accounting treatment for such electric power affirms the national commission performing state regulation in the field of power and utilities. Power suppliers shall buy the electrical energy made on power generation facilities from alternative energy sources in cases, amounts and at the prices determined by this Article.

The electrical energy developed from energy of sunlight and/or wind energy by power generation facilities (the generating installations) of private households which size of installed capacity does not exceed 30 kW is acquired by the power suppliers performing delivery of electrical energy on regulated rate for the territories of production of licensed activity, on "green" rate in the amount exceeding monthly electric power consumption by such private households. The residential customer has the right to establishment in the private household of the generating installation intended for production of electrical energy from energy of sunlight and/or wind energy which size of installed capacity does not exceed 30 kW, but no more capacity, the electrical energy permitted to consumption under the agreement on use. Production of electricity from energy of sunlight and/or wind energy is performed by private households without the corresponding license. Procedure

sale and accounting of such electric power, and also calculations for it affirms the national commission performing state regulation in the field of power and utilities";

4) in Article 17-1:
