About modification of some legal acts of Ukraine concerning regulation of activities of priests (chaplains) in the bodies and organizations relating to the sphere of management of the Public penitentiary service of Ukraine

The Verkhovna Rada of Ukraine decides:

I. Make changes to the following legal acts of Ukraine:

1. The penitentiary code of Ukraine (2004, Art. No. 3-4, 21) to add sheets of the Verkhovna Rada of Ukraine with Article 128-1 of the following content:

"Article 128-1. Organization of vicarial guardianship of convicts

1. Vicarial guardianship of convicts - the activities in organizations of execution of punishments of priests (chaplains) authorized by the religious organizations which charters (provisions) are registered in the procedure established by the law directed to satisfaction of religious needs of convicts, their spiritual education.

2. For coordination of actions of vicarial guardianship of convicts the central executive body realizing state policy in the field of execution of criminal penalties creates advisory body which structure joins representatives of the interested religious centers and managements which charters (provisions) are registered in the procedure established by the law.

3. The procedure for special training of priests (chaplains) and provision of powers on implementation of actions of vicarial guardianship of convicts are approved by the central executive body realizing state policy in the field of execution of criminal penalties.

4. Measures of vicarial guardianship shall not break the procedure for execution and serving of punishments established by the law and other regulatory legal acts.

5. Meetings of priests (chaplains) with convicts are provided in time, free from work (study) of convicts, without restriction of number of meetings in the place determined by administration of organization of execution of punishments.

6. The administration of organizations of execution of punishments promotes ensuring confidentiality of meetings of convicts with priests (chaplains).
