Article 35 to add 1) with Item 2-1 of the following content:
"2-1. The tax-free monthly perpetual maintenance in the amount of fifty percent from official pay rate on the last post of the judge, except cases of suspension or termination of resignation is paid to the judge who is staying in resignation, including retired till January 1, 2016, having years of service of judicial work at least fifteen years, reached the retirement age established by the Law of the Republic of Kazakhstan "About provision of pensions in the Republic of Kazakhstan".
For every year of years of service of judicial work over twenty years, and for the judges who retired till January 1, 2016 - for every year of years of service of judicial work over fifteen years the size of the monthly perpetual maintenance of the judge staying in resignation increases by one percent from official pay rate on the last post of the judge.
The maximum size of the monthly perpetual maintenance of the judge staying in resignation shall not exceed sixty five percent from official pay rate on the last post of the judge and the hundred-ninefold monthly settlement indicator established by the law on the republican budget for the corresponding financial year.
The size of the monthly perpetual maintenance to the judge staying in resignation is estimated on the last post according to the wages system for judges operating for date of the request for payment of the specified content.
