About town-planning activities

This Law establishes legal, economic, organizational basis of the relations arising when implementing town-planning activities and is directed to forming of the full-fledged habitat and life activity of the person, sustainable development of settlements.

Chapter I. General provisions

Article 1. Basic concepts

In this Law the following basic concepts are used:

1) town-planning activities (also – town planning) – the theory and practice of the layout and building of the settlements providing complex of socioeconomic, construction and technical, architectural and art, sanitary and hygienic decisions;

2) town-planning documentation – the system of interconnected project documents, including plans of zoning of the territory determining the directions and conditions of town-planning development and use of the territories;

3) the state town-planning standard rates and rules – system of the regulatory legal acts, town-planning and technical regulations, normative and technical documents, other mandatory requirements, conditions and restrictions shown to building of the territories and providing favorable, safe and other necessary conditions for dwelling and life activity of the person. The state town-planning standard rates and rules are obligatory for execution by subjects of town-planning activities;

4) town-planning regulations – the modes, permissions, restrictions (including encumbrances, prohibitions and servitudes) uses of the territories (parcels of land) and other real estate objects established by town-planning documentation;

5) zoning of the territory – allocation in case of town-planning planning of territorial zones of certain functional purpose with establishment of regulations of town-planning development and use of the territories;

6) city and settlement line – the external border of lands of the settlement separating them other categories of land fund, established by town-planning documentation of detailed planning;

7) red lines – the conditional lines provided by town-planning documentation of detailed planning, intended for department in settlements of lands public from the territories intended for building or other use;

8) lines of regulation of building – the conditional lines provided by town-planning documentation of detailed planning, determining when implementing building of the territory of border of placement of buildings and constructions taking into account space from red lines or from borders of the parcel of land;

9) the mezhselenny territories – the territories which are between settlements outside their borders (line);

10) developer of town-planning (project) documentation – the person having the corresponding license, attracted by the customer, the builder or the contractor to development of the project documentation (designing), implementation of designer's service of construction, accomplishment of other works when implementing town-planning activities according to the procedure and on the conditions provided by the agreement;

11) system of resettlement – purposefully created network of settlements united in whole on the basis of optimization of space, commercial, social and other ties;

12) the territory – the limited space having one or several elements of the habitat and life activity of the person and intended for implementation of town-planning activities, including the territories of settlements, the mezhselenny territories and intended for building or other use;

13) the building – the construction system consisting from the bearing, protecting or combined designs forming the closed amount intended depending on functional purpose for accommodation or stay of people and (or) accomplishment of production engineering procedures of different type;

14) construction – the three-dimensional, plane or linear object (land, surface and (or) underground, underwater) having natural or artificial space borders and intended for accomplishment of production processes, placement and storage of material values or temporary stay (movement) of people, loads, and also placement (laying, posting) the equipment or communications. The construction can also have art and esthetic, arts and crafts or memorial appointment;

15) engineering infrastructure – set of engineering communications (including networks) and the constructions providing giving of resources (energy, water and another) and assignment of the used resources;

16) transport infrastructure – set of the communications of road, rail, water, air, pipeline transport intended for traffic circulation, pedestrians, movement of passengers and loads including products, on the territories of settlements and the mezhselenny territories;

17) social infrastructure – complex of buildings, constructions of social and household purpose, including buildings and constructions of the organizations of education system, culture, art, physical culture, sport, health care, trade, consumer services, housing and communal services and other objects providing life activity of the population, including the available circle for persons with disability;

18) the scheme of the layout of the territory – the town-planning documentation providing the plan of zoning of the territory, the basic principles of system of resettlement and development of settlements, development of industries of economy, engineering, transport and social infrastructure of the corresponding territory;
