About modification and amendments in some legal acts

The Parliament adopts this organic law.

Art. I. – In the Code of civil procedure of the Republic of Moldova No. 225-XV of May 30, 2003 (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 130-134, 415), with subsequent changes to make the following changes and additions:

1. Part (3) articles 5 after words "the parties from" to add with the word of "right", and the word "devolution agreements of dispute to reference tribunal." shall be replaced with words "the arbitral agreement.".

2. In Article 81 of the word "case referral in reference tribunal," shall be replaced with words "the request for the dispute resolution in arbitration,".

3. In Item d) parts (1) Article 169 of the word "decision of reference tribunal", shall be replaced with words "arbitral decision", and words "decisions of reference tribunal or cancelled the decision of reference tribunal;" shall be replaced with words "the arbitral decision or cancelled the arbitral decision;".

4. In Item е) parts (1) Article 185 of the word "reference tribunal" to replace with the word "arbitration".

5. In part (Article 467 of the word "rightfully" to exclude 1).

6. State Article 475 in the following edition:

"Article 475. Recognition and execution of the foreign arbitral decision

(1) According to provisions of this Chapter the arbitral decision is considered foreign if it:

a) it is taken out in the territory of foreign state; or

b) it is taken out in the territory of the Republic of Moldova using to arbitration procedure of the foreign law.
