Article 1

1) Article 3 to add with part 3 following of content:

"3. Provisions of this Federal Law do not extend to the relations settled by single competition rules in the cross-border markets which control of observance is within the competence of the Eurasian economic commission according to the international treaty of the Russian Federation. Criteria of reference of the market to cross-border are established according to the international treaty of the Russian Federation.";

2) in Article 4:

a) in Item 19 of the word "goods. The agency agreement is not the "vertical" agreement;" to replace with the word "goods;";

b) add with Item 23 following of content:

"23) the consumer - the legal entity or physical person acquiring goods.";

3) in Article 5:

"4) legal entities in whom more than fifty percent of quantitative structure of collegiate executive body and (or) the board of directors (the supervisory board, council of fund) make the same physical persons;";

5) in the name of Chapter 2 of the word "activities. The unfair competition" to replace with the word "activities";

6) in Article 10:

a) the paragraph one of part 1 after words of "other persons" to add with words "(business entities) in the field of business activity or uncertain circle of consumers";

b) add with parts 5 - 7 following contents:

"5. In case of identification of the fact of abuse of business entity of dominant position determined by the decision of antimonopoly authority which took legal effect for the purpose of the prevention of creation of discrimination conditions of the rule of non-discriminatory access to the goods made and (or) the implementable business entity holding dominant position and not being subject of natural monopoly which share in the corresponding goods market constitutes more than seventy percent are established by the act of the Government of the Russian Federation (rules of non-discriminatory access to services of the financial organizations, persons under surveillance to the Central bank of the Russian Federation, affirm federal antimonopoly authority in coordination with the Central bank of the Russian Federation). The specified rules shall contain:

3) procedure for disclosure of information, stipulated in Item 2nd this part, including about goods, the cost of these goods or the principles of determination of the price of goods and its payment, possible production volume or realization of these goods, technical and technological capabilities of provision of these goods;

4) essential conditions of agreements and (or) standard agreements about provision of access to goods;

5) procedure for determination of the consumers who are subject to obligatory servicing, establishments of the minimum level of their providing and priority of provision of access to goods in case of impossibility of satisfaction in full of the needs for goods taking into account need of protection of the rights and legitimate interests of citizens, safety of the state, conservation and cultural values.

6. The rules provided by part 5 of this Article may contain condition about obligatory sale of goods at the biddings.

7. Rules of non-discriminatory access to the services rendered by the operator of the National Payment Card System, operators of services of payment infrastructure of the National Payment Card System, operator of payment system of the Central bank of the Russian Federation, the operator of services of payment infrastructure of payment system of the Central bank of the Russian Federation are determined according to the procedure, established by the Federal Law "About National Payment System".";

7) in Article 11:

a) the paragraph one of part 1 after words "goods market" to add with the words "or between the business entities performing purchase of goods in one goods market";

b) add with part 10 of the following content:

"10. Requirements of this Article do not extend to the agreements on joint activities signed from prior consent of the antimonopoly authority received according to the procedure, established by Chapter 7 of this Federal Law.";

8) regarding the 2nd Article 12 of the word "any goods market" shall be replaced with words "the goods market of the goods which are subject of the "vertical" agreement";
