About electronic commerce

This Law determines organization-legal bases of activities in the field of electronic commerce in Ukraine, establishes procedure for making of electronic transactions using information and communication systems and determines the rights and obligations of participants of the relations in the field of electronic commerce.

The Section I General provisions of functioning of electronic commerce in Ukraine

Article 1. Scope of this Law

1. This Law governs legal relations in the field of electronic commerce during making of electronic transactions.

2. Operation of this Law does not extend to transactions if:

the special procedure for transition of the property right is established by the law or subject of the transaction are the objects withdrawn from civil circulation or limited in civil circulation according to the legislation;

one of the parties is the physical person which is not registered as physical person entrepreneur and which implements or offers to realization goods, performs works, renders services with use of information and communication systems, except cases when the parties directly agreed about application of provisions of this Law to the transaction;

the party of the transaction is the public authority or local government body regarding accomplishment of functions of the state by it or local self-government or the transaction is made according to the Law of Ukraine "About public purchases";

the transaction is subject to the notarial certificate or state registration according to the legislation;

transaction regulates family legal relationship;

the transaction concerns gaming, including bet, totalizators and other gamblings, or carrying out lotteries, except non-cash lotteries according to the Law of Ukraine "About charity and charitable organizations" and the lotteries determined by the Law of Ukraine "About advertizing";
