About modification of the Presidential decree of the Republic of Belarus

Item 369 of the Regulations on licensing of separate types of activity approved by the Presidential decree of the Republic of Belarus of September 1, 2010 No. 450 "About licensing of separate types of activity" (The national register of legal acts of the Republic of Belarus, 2010, No. 212, 1/11914; The National legal Internet portal of the Republic of Belarus, 25.02.2015, 1/15661) to state in the following edition:

"369. Legal entities of the Republic of Belarus have the right to the license.".

The licensees which had special permission (license) for wholesale trade and storage of alcoholic, non-food alcohol-containing products, non-food ethyl alcohol and tobacco products for July 1, 2015 (further in this Item - special permission (license) and more than 25 percent of shares (share in authorized funds) of such licensees which lost the right to implementation of the works and (or) services included in special permission (license) in connection with failure to meet requirement about availability in property of the state having the right to address till December 1, 2015 to the licensing body which made the decision on cancellation of special permission (license) or on exception of special permission (license) of the constituting works and (or) services with the statement for renewal of action of special permission (license) or for amendment of special permission (license) the constituting works and (or) services. Data on accomplishment for date of filing of application of the licensed requirements and conditions provided by the Presidential decree of the Republic of Belarus of February 20, 2015 No. 92 "About modification and amendments in the Presidential decree of the Republic of Belarus" are also specified in the statement (The national legal Internet portal of the Republic of Belarus, 25.02.2015, 1/15661). The licensing body within 3 working days from the date of receipt of the corresponding statement of the licensee makes the decision on renewal of action of special permission (license) or on entering of amendment into special permission (license) regarding the constituting works and (or) services what within 3 working days from the date of adoption of such decision in writing notifies the licensee on.

In case of renewal of action of special permission (license) or amendment of special permission (license) the constituting works and (or) services in the cases specified in part one of this Item, the state fee is not collected.

The licensees specified in part one of this Item on which the licensing body does not make the decision on cancellation of special permission (license) or on exception of special permission (license) of the constituting works and (or) services having the right to perform wholesale trade and storage of alcoholic, non-food alcohol-containing products, non-food ethyl alcohol and tobacco products based on earlier issued special permission (license) for the specified type of activity on condition of the direction in the licensing body in a month from the effective date of this Decree of the notification on accomplishment of the licensed requirements and conditions provided by the Presidential decree of the Republic of Belarus of February 20, 2015 No. 92.

3. This Decree becomes effective after its official publication. Action of part three of Item 2 of this Decree extends to the relations which arose since October 1, 2015.
