About approval of the Order of interaction of authorized state bodies of the Kyrgyz Republic at automobile check points through customs border of the Eurasian Economic Union
For the purpose of determination of order of interaction of the state monitoring bodies at automobile check points through customs border of the Eurasian Economic Union and in pursuance of Item 71 of the Actions plan ("road map") on accession of the Kyrgyz Republic to the Customs union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation approved by the order of the Government of the Kyrgyz Republic No. 445 of August 5, 2014, we order:
1. Approve the enclosed Order of interaction of authorized state bodies of the Kyrgyz Republic at automobile check points through customs border of the Eurasian Economic Union (further - the Procedure).
2. To heads of the state bodies involved performed by this order:
- determine responsible persons for strict observance and execution of the Procedure approved by this order and to inform the State Customs Service under the Government of the Kyrgyz Republic in week time;
- post this order on the official sites of state bodies;
- provide bringing to data of interested persons;
- provide control of execution of this order.
3. This order becomes effective from the effective date Treaties of Accession of the Kyrgyz Republic to the Agreement on the Eurasian Economic Union of May 29, 2014.

1. This Order of interaction of authorized state bodies of the Kyrgyz Republic at automobile check points through customs border of the Eurasian Economic Union (further - the Procedure) determines the sequence of actions when implementing border, customs and other control (further - the state control) at automobile check points through customs border of the Eurasian Economic Union (further - check points).
2. The state control is exercised at check points by officials of authorized state body on protection of frontier, authorized state body in the field of customs affairs, authorized state body in the field of health care, the authorized state body on supervision and control in the field of veterinary and phytosanitary safety authorized in the field of transport (further - the state regulatory authorities) within the powers established by the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic.
3. The means and control methods used when implementing the state control concerning vehicles, drivers, passengers of loads, goods and animals are applied according to the procedure, established by the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic.
4. Based on the Procedure and taking into account specifics of each check point, the body of border control at check points develops technological schemes of the organization of the omission through customs border of the Eurasian Economic Union of persons, vehicles, loads, goods and animals who are approved with other state bodies performing control functions at check points. The approved technological schemes affirm heads of subordinated territorial subdivisions of the state regulatory authorities under which structural supervision the state monitoring bodies at check points are.
5. In case of arrival in the check point on customs border of the Eurasian Economic Union of cargo vehicles, the following sequence of implementation of control actions by state bodies is established:
1) the entry visa at check points of cargo vehicles (border control);
2) sanitary and quarantine control of persons (in the presence of the objective sanitary and epidemiologic bases and only at check points where such type of control is provided):
- poll of persons following in vehicles about availability of claims to the state of health;
- verification of documents in the part concerning sanitary and quarantine control;
- decision making about need of implementation of other actions for sanitary quarantine control;
- introduction of the plan of operational actions in case of identification of patients, suspicious on infection with especially dangerous infectious disease;
- decision making about provision to persons of the right of further following;
3) border control:
- verification of documents on the right of crossing of frontier of the Kyrgyz Republic at drivers, persons accompanying goods;
- informing the shift supervisor of customs authority on adoption of the joint decision on carrying out survey/examination of cargo vehicles;
- entering of results of border control in information system;
- decision making about provision to persons and the vehicle of the right of further following;
4) veterinary control (if necessary and only at check points where such type of control is provided):
- documentary control;
- survey of animals;
- survey of goods and loads;
- informing the shift supervisor of customs authority on the made decision on carrying out examination of the cargo vehicle;
- goods inspection, loads and animals (if necessary) together with customs and other interested state regulatory authorities;
- assessment of veterinary and sanitary condition of the vehicle;
- decision making about permission of commodity importation, loads and animals or about omission prohibition through customs border of the Eurasian Economic Union of loads, goods and animals;
- informing customs authority on opportunity omission/prohibition of commodity importation, loads and animals through customs border of the Eurasian Economic Union by entering of data into information system or by the notice in writing (creation of the act), and also with putting down on shipping documents of the corresponding stamps;
5) phytosanitary control (if necessary and only at check points where such type of control is provided):
- verification of accompanying documents on each batch of quarantine products (quarantine freights, quarantine materials): phytosanitary certificate, import quarantine permission; other documents confirming phytosanitary condition of quarantine products, provided according to international treaties of the Kyrgyz Republic and (or) with requirements of the importer according to agreements (contracts) with it;
- carrying out visual survey of the vehicle on availability of utilities, integrity and hermeticity, lack of signs of finding of quarantine harmful organisms, pro-rashes of soil and seeds of weed plants;
- informing the shift supervisor of customs authority on the made decision on carrying out examination of the cargo vehicle;
- carrying out phytosanitary examination (if necessary) together with customs and other interested state regulatory authorities;
- visual survey of internal surfaces of body and cabin, packaging of load;
- decision making about withdrawal, destruction or performing disinfecting or cleaning (if necessary);
- informing customs authority on opportunity omission/prohibition of import of quarantine products (quarantine freight, quarantine material) through customs border of the Eurasian Economic Union by entering of data into information system or by the notice in writing (creation of the act), and also with putting down on shipping documents of the corresponding stamps;
6) transport control:
- vehicle registration;
- weighing and measurement of dimensions of the vehicle;
- reconciliation of the state registration numbers;
- check of distinctive marks of the state in the territory of which the vehicle is registered;
- verification of documents in the part concerning transport control: the car driver license, the registration certificate and other documents concerning the international freight transportation, permission to driving of the vehicle through the territory of the Eurasian Economic Union and the territory of the Kyrgyz Republic (for foreign haulers), licenses to the international road haulage (for domestic haulers), documents to transportation of dangerous goods, special authorities for the move of bulky, heavy and dangerous goods, commodity-transport documentation, the international certificate of technical inspection and weighing of the vehicle, etc.;
- availability of the tachograph or registration leaves of accounting of work-rest schedule of drivers;
- issue of the accounting coupon to carrier in the form approved with bodies of transport (automobile) control if according to the legislation of other state members implementation of transportation is allowed without the permission on driving through the territories of other state members and also if it is transported according to multilateral permission;
- issue of the notification to the driver in the form approved by bodies of transport (automobile) control of state members in case of absence or discrepancy of documents, stipulated by the legislation state members;
- entering of results of transport control in information system;
- decision making about provision to the vehicle of the right of further following and informing customs authority on it;
7) customs control:
- verification of documents and data on goods and vehicles, production of necessary customs procedures according to the procedure, determined by the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic in the field of customs affairs;
- survey of cargo vehicles;
- decision making about carrying out joint survey / examination of the cargo vehicle and goods, and in need of drivers of the vehicles, freight forwarders and other persons accompanying vehicles, goods and animals according to the statement of one or several state regulatory authorities and the notice of relevant organs of the state control;
- entering of results of customs control in information system;
- upon completion of customs control of the vehicle and goods the customs authority informs carrier on the made decision concerning moved with it through customs border of the Eurasian Economic Union of the vehicle and goods;
8) the state regulatory authority which made the decision on omission prohibition through customs border of the Eurasian Economic Union of vehicles, loads, goods and animals draws up it in writing;
9) information exchange between the state regulatory authorities at the check point is performed with use of electronic means of processing and data transmission if other is not stipulated by the legislation the Eurasian Economic Union and the legislation of the Kyrgyz Republic concerning separate categories supplied and the information or methods/channels of transfer;
10) departure of cargo vehicles from the check point is made with the permission of boundary body.
6. In case of departure from customs area of the Eurasian Economic Union of cargo vehicles the following sequence of implementation of control actions by the state regulatory authorities at check points is established:
1) the entry visa to the check point of cargo vehicles and their registration (border control);
2) sanitary and quarantine control (in the presence of objective sanitary and epidemiologic indications and only at check points where such type of control is provided):
- poll of persons following in cargo vehicles about availability of claims to the state of health;
- verification of documents in the part concerning sanitary and quarantine control;
- control of conditions of transportation;
- introduction of the plan of operational actions in case of identification of patients, suspicious on infection with especially dangerous infectious disease;
- entering of results of sanitary and quarantine control in information system;
- decision making about provision to persons of the right of further following;
3) veterinary and phytosanitary control (if necessary and only at check points where such type of control is provided):
- documentary control, including verification of accompanying documents on exported from customs area of the Eurasian Economic Union concerning under control loads, goods and animals;
- survey of animals;
- survey of loads and goods;
- informing the shift supervisor of customs authority on the made decision on carrying out examination of the cargo vehicle;
- informing customs authority on possibility of omission/prohibition of cargo exportation, goods and animals through customs border of the Eurasian Economic Union by entering of data into information system, or by the notice in writing (creation of the act), and also with putting down on shipping documents of the corresponding stamps;
4) transport control:
- vehicle registration;
- weighing and measurement of dimensions of the vehicle (if necessary);
- reconciliation of the state registration numbers;
- check of distinctive marks of the state in the territory of which the vehicle is registered;
- verification of documents in the part concerning transport control: the car driver license, the registration certificate and other documents concerning the international freight transportation, permission to driving of the vehicle through the territory of the Kyrgyz Republic and the territory of the Eurasian Economic Union (for foreign haulers), licenses to the international road haulage (for domestic haulers), documents to transportation of dangerous goods, special authorities for the move of bulky, heavy and dangerous goods, commodity-transport documentation, the international certificate of technical inspection and weighing of the vehicle, etc.);
- availability of the tachograph or registration leaves of accounting of work-rest schedule of drivers;
- availability at carrier of the receipt on payment of charges for driving of the vehicle through highways of state members on which territories journey was performed if payment of such collection is obligatory according to the legislation of state members;
- availability at carrier (driver) of the receipt confirming payment of penalty for violation of procedure for accomplishment of the international motor transportations in the territory of state member or the decision of judicial authorities on grievance settlement on the resolution on imposing on carrier (driver) of the corresponding administrative punishment if in permission to driving through the territory of one of state members or in the accounting coupon there is mark of body of transport (automobile) control about imposing on carrier (driver) of such penalty;
- release of the vehicle from the territory of the Eurasian Economic Union is not performed before presentation of documents by carrier which availability is provided by Items 7 and 8 of this Procedure;
5) customs control:
- verification of documents and data on goods and vehicles, production of necessary customs procedures according to the procedure, determined by the legislation of the Eurasian Economic Union;
- survey of cargo vehicles;
- decision making about carrying out joint survey / examination of the cargo vehicle and goods, and in need of drivers of the vehicles, freight forwarders and other persons accompanying vehicles, goods and animals according to the statement of one or several state regulatory authorities and the notice of relevant organs of the state control;
- entering of results of customs control in information system;
- upon completion of customs control of the vehicle and goods the customs authority informs carrier on the made decision concerning moved with it through customs border of the Eurasian Economic Union of the vehicle and goods;
6) the state regulatory authority which made the decision on omission prohibition through customs border of the Eurasian Economic Union of vehicles, loads, goods and animals draws up it in writing;
7) border control:
- verification of documents on the right of crossing of frontier at transport drivers, persons accompanying goods;
- survey of cargo vehicles;
- informing the shift supervisor of customs authority on the made decision on carrying out examination of the cargo vehicle;
- examination (in need of) cargo vehicles together with customs authority and with participation of representatives of the relevant state regulatory authorities according to the procedure, determined by the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic;
- entering of results of border control in information system;
- decision making about provision to persons and the vehicle of the right of further following;
- making the exit visa of cargo vehicles from the check point;
8) information exchange between the state regulatory authorities at the check point is performed with use of electronic means of processing and data transmission if other is not stipulated by the legislation the Eurasian Economic Union and the legislation of the Kyrgyz Republic concerning separate categories supplied and the information or methods/channels of transfer;
9) departure of cargo vehicles from the check point is made with the permission of boundary body.
7. In case of arrival on customs area of buses and automobile vehicles in cabins of passport control or rooms which are specially equipped for this purpose the following sequence of control actions of the state regulatory authorities at check points is established:
1) the entry visa to the check point of buses and automobile vehicles (border control);
2) sanitary and quarantine control of persons (in the presence of the objective sanitary and epidemiologic bases and only at check points where such type of control is provided):
- poll of persons following in vehicles about availability of claims to the state of health;
- verification of documents in the part concerning sanitary and quarantine control;
- decision makings about need of implementation of other actions for sanitary quarantine control;
- introduction of the plan of operational actions in case of identification of patients, suspicious on infection with especially dangerous infectious disease;
- decision making about provision to persons of the right of further following;
3) border control:
- verification of documents on the right of crossing of frontier of the Kyrgyz Republic at drivers, and also at the passengers following in buses and automobile vehicles;
- survey of buses and automobile vehicles;

- verification of accompanying documents on the right of import to customs area of the Eurasian Economic Union of things of faces and baggage of passengers in the part concerning veterinary and phytosanitary control;
- decision making about provision to under control objects of the right of their further following;
5) transport control:
- vehicle registration;
- reconciliation of the state registration numbers of buses;
- check of distinctive marks of the state in the territory of which the bus is registered;
- verification of documents in the part concerning transport control: the car driver license and the registration certificate, the route sheet and card of the admission to the international road haulage (for domestic haulers), permissions to opening of the international bus route, the scheme of route and the schedule, the authority for the move of passengers on customs area of the Eurasian Economic Union and on the territory of the Kyrgyz Republic (for foreign haulers), etc. the documents necessary for the international passenger traffic;
- passenger manifest availability in case of the international irregular carriages of passengers;
