About approval of the Order of interaction of authorized state bodies of the Kyrgyz Republic at railway check points through customs border of the Eurasian Economic Union

For the purpose of determination of order of interaction of the state monitoring bodies at railway check points through customs border of the Eurasian Economic Union and in pursuance of Item 71 of the Actions plan ("road map") on accession of the Kyrgyz Republic to the Customs union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation approved by the order of the Government of the Kyrgyz Republic No. 445 of August 5, 2014, we order:

1. Approve the enclosed Order of interaction of authorized state bodies of the Kyrgyz Republic at railway check points through customs border of the Eurasian Economic Union (further - the Procedure).

2. To heads of the state bodies involved performed by this order:

- determine responsible persons for strict observance and execution of the Procedure approved by this order and to inform the State Customs Service under the Government of the Kyrgyz Republic in week time;

- post this order on the official sites of state bodies;

- provide bringing to data of interested persons;

- provide control of execution of this order.

3. This order becomes effective from the effective date Treaties of Accession of the Kyrgyz Republic to the Agreement on the Eurasian Economic Union of May 29, 2014.

Order of interaction of authorized state bodies of the Kyrgyz Republic at railway check points through customs border of the Eurasian Economic Union

I. General provisions

1. This Order of interaction of authorized state bodies of the Kyrgyz Republic at railway check points through customs border of the Eurasian Economic Union (further - the Procedure) determines the sequence of control actions when implementing border, customs and other control (further - the state control) at railway check points through customs border of the Eurasian Economic Union (further - check points).

2. The state control is exercised at check points by officials of authorized state body on protection of frontier, authorized state body in the field of customs affairs, authorized state body in the field of health care, authorized state body on supervision and control in the field of veterinary and phytosanitary safety (further - the state regulatory authorities) within the powers established by the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic.

3. When implementing the state control means and methods according to the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic are applied.

4. Based on the Procedure and taking into account specifics for each check point the body of border control at check points develops technological schemes of the organization of the omission through customs border of the Eurasian Economic Union of persons, vehicles, loads, goods and animals who are approved with heads of other state regulatory authorities at check points. The approved technological schemes affirm heads of subordinated territorial subdivisions of the state regulatory authorities under which structural supervision the state regulatory authorities at check points are.

5. The state regulatory authorities shall take all feasible measures on minimization of time of carrying out the state control and non-admission of unreasonable delays of train service of the international message (further - trains).

In case of identification of the violations causing train delay, the state regulatory authorities inform the chief of the train and the person on duty on the railway station on the reasons and expected duration of delay.

6. In 1 hour prior to arrival of the train the person on duty on the railway station informs regulatory authorities on arrival of the train in the check point.

7. Carrying out shunting works on adjacent railway tracks during the state control of trains is not allowed.

8. Workers of crew of train of passenger trains before arrival of the train in the check point provide finding of passengers on the places with the documents prepared for control, hand luggage, and also with customs declarations (if necessary).

9. Movement of passengers during the state control is allowed only with the permission of the state regulatory authorities. Work of dining-cars for the period of carrying out the state control stops.

10. In the presence in passenger trains of luggage cars the state regulatory authorities perform their external survey, verification of carriage and accompanying documents on the transported goods and baggage. The interested state regulatory authorities inform the shift supervisor of customs authority on need of examination of luggage cars.

11. Examination of luggage cars and the goods transported in them and baggage is performed by the state regulatory authorities once in the presence of the representative of carrier (person who is actually transporting goods, including through frontier, or being responsible for use of the vehicle).

12. The state regulatory authorities inform the shift supervisor of border duties and the person on duty on the railway station on the end of carrying out the state control.

13. Duration of parking of trains of the international message at check points shall be sufficient for carrying out their state control.

II. The state control of the passenger trains arriving to customs area of the Eurasian Economic Union

14. Before arrival of the train in the check point from the platform all strangers leave. Behind the arriving train, and also entrances and exits to the platform border duties establish observation. During the state control of the train with the permission of the shift supervisor of border duties on the platform only those persons who need it for accomplishment of service duties are allowed.

15. Before the state control by the state regulatory authorities at the chief of the train information on stay which is available for it in the train of patients, suspicious on disease of persons, persons which illegally got into the train and also persons without documents on the right of entry into the Kyrgyz Republic, loads, goods and the animals prohibited to import to customs area of the Eurasian Economic Union is specified.

16. Sanitary and quarantine control of persons following through frontier if necessary is performed before carrying out other types of the state control.

17. Verification of documents at persons driving on the territory of the Kyrgyz Republic is made, as a rule, in cabins of passport control in station complexes, is direct in cars and can be performed by several groups of border duties.

18. The border duties beginning control with the train head check documents at members of locomotive crew and perform inspection of the locomotive.

19. Internal car inspection is performed by border duties in parallel with verification of documents at passengers.

20. Customs and other types of control of hand luggage and baggage are carried out after check at their owners by border duties of documents on the right of crossing of frontier. If necessary border and customs control can be carried out at the same time.

21. Exit of passengers whose transit comes to an end at the check point is allowed upon termination of border and customs control in the car, without waiting for the end of control in other cars.

22. The state control of passengers whose transit comes to an end at the check point can be also made by the state regulatory authorities in the rooms of the check point which are specially equipped for this purpose.

23. The administration of the railway station in coordination with divisions of boundary and customs authority provides control of movement of passengers and goods (baggage of passengers) which transit comes to an end at the check point, from the train to the place of implementation of the state control.

24. The shift supervisor of border duties informs the person on duty on the railway station on the end of the state control of the train and removal of regime restrictions.

III. The state control of the passenger trains decreasing from customs area of the Eurasian Economic Union

25. Before arrival of the train in the check point from the platform all strangers leave. Behind the arriving train, and also entrances and exits to the platform border duties establish observation. During the state control of the train with the permission of the shift supervisor of border duties on the platform only those persons who need it for accomplishment of service duties are allowed.

26. Before the state control by the state regulatory authorities at the chief of the train information on stay which is available for it in the train of patients, suspicious on disease of persons, and also persons without documents on the right of departure from the Kyrgyz Republic (persons which illegally got into the train), loads, goods and the animals prohibited to import to customs area of the Eurasian Economic Union is specified.

27. If necessary before carrying out customs control sanitary and quarantine, veterinary and phytosanitary control is exercised.

28. After carrying out the corresponding type of control bodies of sanitary and quarantine, veterinary, phytosanitary control make the decision and inform customs authorities on the omission or prohibition of export of hand luggage, baggage of the passengers decreasing from the territory of the Kyrgyz Republic.

29. Internal car inspection and baggage is performed by customs authorities with involvement of members of crew of train.

30. Survey of rooms of cars is performed by border duties in parallel with verification of documents at passengers.

31. Survey/examination of cars and goods (baggage of passengers) is performed with involvement of members of crew of train.

32. Verification of documents at persons leaving from the territory of the Kyrgyz Republic is made, as a rule, in cabins of passport control in station complexes, is direct in cars and can be performed by several groups of border duties.

The border duties beginning control with the train head check documents at members of locomotive crew and perform internal inspection of the locomotive.

33. The state control of the passengers leaving the Kyrgyz Republic can be also made by the state regulatory authorities in the rooms of the check point which are specially equipped for this purpose.

34. The administration of the railway station in coordination with divisions of boundary and customs authority provides control of movement of passengers and goods (baggage of passengers) which transit begins at the check point, from the place of implementation of the state control to the train.

35. The state regulatory authorities inform the shift supervisor of border duties and the person on duty on the railway station on the end of the state control of the train.

36. Regime restrictions concerning prohibition (restriction) of the admission to the train of strangers remain before its departure from the check point.

37. Departure of the train by the person on duty on the railway station without approval of divisions of boundary and customs authorities is not allowed.

38. In case of departure of the train from the check point the border duty performs external survey of the train. In case of identification during survey of the train of violators of frontier the border duty immediately informs the person on duty on the railway station for taking measures to stop of the train and suppression of violation.

39. In coordination with administration of the railroad the state regulatory authorities can exercise the state control of the passengers following from the Kyrgyz Republic, their hand luggage and baggage and also internal car inspection during following of trains from internal railway stations to the check point on customs border of the Eurasian Economic Union.

IV. The state control of the cargo trains arriving to customs area of the Eurasian Economic Union

40. The administration of the railway station beforehand sends to the state regulatory authorities at the check point the train schedule approved in accordance with the established procedure by railway administrations. In case of changes in the traffic schedule the administration of the railway station informs on it the state regulatory authorities located at the check point, at least per day.

41. The state control of cargo trains is exercised by the state regulatory authorities with employees engagement of the railway station.

42. Coordination of process of the state control is assigned to bodies of border control.

43. In 1 hour prior to arrival of the train the person on duty on the railway station and the authorized employee of carrier inform the state regulatory authorities on quantity and type of cars in the train, nature of the loads and goods transported through customs border of the Eurasian Economic Union in volume of the train transfer sheet received from adjacent railway administration (further - PPV).

44. On the basis of the acquired information the state regulatory authorities plan control actions.

45. Before arrival of the train in the check point from control zone (from the customs platform) all strangers leave. Behind the arriving train border duties establish observation.

46. Only those persons who need it for accomplishment of service duties are allowed to the train which arrived to the check point with the permission of the shift supervisor of border duties.

47. After arrival of the train the authorized employee of carrier (person who is actually transporting goods, including through frontier, or being responsible for use of the vehicle) with the permission of the senior border duty receives carriage and shipping documents from locomotive crew, processes them and unpacks PPV.

48. After processing carriage and shipping documents are reported together with PPV to the authorities of customs control for control of documents with entering of time of document transfer in the magazine of acceptance delivery of documents.

49. In cases when the load is subject to veterinary or phytosanitary control, the specified carriage and shipping documents are provided by bodies of customs control in the relevant state regulatory authorities.

50. The state regulatory authorities with employees engagement of the railway station start car inspection of the train. At the same time car inspection can be performed by several groups.

51. The border duties beginning car inspection with the train head check documents at members of locomotive crew and perform internal survey of the locomotive.

52. If necessary before border control sanitary and quarantine control of members of locomotive crew can be exercised.

53. Upon the demand of the state regulatory authorities separate cars of the train can be opened and examined. The facts of opening of cars and results of their examination are reflected in the act of examination which is signed by representatives of the state regulatory authorities and the railroad.

54. Concerning loads, goods, substances and waste sanitary and epidemiologic requirements are imposed in cases if there are sanitary and epidemiologic bases to consider that these loads, goods, waste and substances could be infected with causative agents of any disease to which health regulations (availability of insects, rodents and traces of their stay) extend; there is excess of admissible values of capacity of dose of radiation and superficial pollution by radionuclides in transit of radioactive materials, in the presence of dangerous goods in defective package with content leakage signs. In the presence of the above-mentioned bases the train according to the instruction of the relevant state regulatory authority is taken away in separate railway track or the deadlock.

55. In case of detection during the survey (examination) of the train of violators of frontier or objects prohibited to import to the territory of the Eurasian Economic Union of the decision of body of border or customs control repeated examination of the train can be carried out.

56. The shift supervisor of border control informs the person on duty on the railway station on the end of survey/examination of cars of the train.

57. Bodies of border control lift additional regime limits in control zone (on the customs platform) concerning the inspected (looked-through) train.

58. The state regulatory authorities continue (complete) processing of carriage and shipping documents.

59. Customs authority in case of production of customs procedures:

receives customs and shipping documents from carrier;

checks reliability of the data containing in documents;

performs inspection (examination) of the vehicle, joint with other state regulatory authorities, and goods.

60. The examination of the vehicle and goods which is carried out by the state regulatory authorities is made in compulsory attendance of representatives of carrier and customs authority.

61. In case of customs examination of empty private cars and containers (follow in the sealed-up condition) presence of owners of railway rolling stock is not required.

62. After completion customs, control of vehicles and goods the customs authority informs carrier on the made decision concerning the vehicles and goods moved with it through customs border of the Eurasian Economic Union.

63. The state regulatory authority which made the decision on omission prohibition through customs border of the Eurasian Economic Union of vehicles, loads, goods and animals draws up it in writing.

64. Customs control at check points through customs border of the Eurasian Economic Union of the loads, goods, animals and vehicles which are subject to veterinary or phytosanitary control can be complete only after implementation of veterinary or phytosanitary control.

65. Veterinary control is exercised in the following procedure:

- verification of veterinary accompanying documents on the goods which are subject to veterinary control, loads and animals;

- survey of animals;

- survey of goods and loads;

- sampling (is model) for researches (if necessary);

- sampling (is model) from the controlled products which are subject to examination with creation of the sampling report (samples).

In case of acceptance by body of veterinary control of the decision on carrying out examination of cars with unloading of load such cars are subject to uncoupling from structure of the created train.

66. After holding all control actions the body of veterinary control informs customs authority on opportunity omission/prohibition of cargo importation, goods and animals through customs border of the Eurasian Economic Union.

67. Phytosanitary control is exercised in the following procedure:

- verification of accompanying documents on quarantine products;

- by results of verification of documents on quarantine products mark in PPV of cars, containers; for carrying out phytosanitary control. In case of acceptance by body of phytosanitary control of the decision on carrying out examination of cars with unloading of load such cars are subject to uncoupling from structure of the created train;

- phytosanitary control of cars, containers is performed together with customs authority.

68. In case of need the body of phytosanitary control makes sampling (samples) of quarantine freight for examination, the laboratory analysis and examination, the sampling report (samples) is drawn up.

69. Body of phytosanitary control following the results of the held control events make the decision on opportunity and conditions of further transportation of quarantine freight.

70. The relevant state regulatory authorities inform the person on duty on the railway station on the end of the state control of the train.

71. Departure of the train from the check point is performed in coordination with bodies of border and customs control.

V. The state control of the cargo trains decreasing from customs area of the Eurasian Economic Union

72. In 1 hour prior to arrival of the train the person on duty on the railway station and the authorized employee of carrier inform the state regulatory authorities on quantity and type of cars in the train, nature of the loads and goods transported through frontier in volume of the telegram - natural leaf of the train.

73. In case of arrival of the train in the check point border duties perform its external survey.

74. After arrival of the train the authorized employee of carrier processes the carriage and shipping documents received from locomotive crew and reports them to the authorities of customs control with entering of time of document transfer in the magazine of acceptance delivery of documents.

75. Documents on cars, containers and contrailers concerning which it is necessary to exercise sanitary and quarantine, veterinary or phytosanitary control, are transferred to the relevant state regulatory authority.

76. The body of veterinary control checks veterinary accompanying documents for the goods transported by train, loads and animals. By results of check makes the decision on permission or prohibition of cargo exportation, goods and animals from customs area of the Eurasian Economic Union, and also need of examination of separate cars and informs on it customs authority.

77. The body of phytosanitary control checks accompanying documents for the quarantine products transported by train.

78. By results of check the body of phytosanitary control makes the decision on permission or prohibition of export of quarantine products from customs area of the Eurasian Economic Union with issue (replacement) of the phytosanitary certificate, and also need of examination of separate cars and informs on it customs authority.

79. Customs authority, having checked reliability of the data containing in documents on the loads and goods transported by train taking into account information obtained from bodies of sanitary and quarantine, veterinary or phytosanitary control if necessary determines cars (loads) which are subject to examination.

80. The state regulatory authorities with employees engagement of the railway station start car inspection of the train. At the same time car inspection can be performed by several groups.

81. Coordination of work of groups is assigned to bodies of border control.

82. The body of customs control informs bodies of border control on the cars which are subject to opening and examination by results of verification of shipping documents.

83. If necessary upon the demand of the state regulatory authorities in selective procedure also other separate cars of the train can be opened and examined.

84. The facts of opening of cars and results of their examination are reflected in the act of examination signed by representatives of the state regulatory authorities and the railroad.

85. By results of examination the state regulatory authorities timely inform administration of the railway station (the person on duty on the railway station) on need of uncoupling of separate cars which omission through frontier is not resolved, and also determine procedure for further actions in their relation.

86. The border duties completing car inspection in the train head check documents at members of locomotive crew and perform internal survey of the locomotive.

87. Seniors of changes of bodies of border or customs control inform on the end of control of the person on duty on the railway station.

88. Regime restrictions concerning prohibition (restriction) of the admission to the train of strangers remain before its departure from the check point.

89. Departure of the train by the person on duty on the railway station without approval of bodies of border and customs control is not allowed.

90. In case of departure of the train from the check point the border duty performs its external survey. In case of identification during survey of the train of violators of frontier the border duty immediately informs the person on duty on the railway station for taking measures to stop of the train and suppression of violation.
