About approval of the Order of interaction of authorized state bodies of the Kyrgyz Republic at air check points through customs border of the Eurasian Economic Union

For the purpose of determination of order of interaction of the state monitoring bodies at air check points through customs border of the Eurasian Economic Union and in pursuance of Item 71 of the Actions plan ("road map") on accession of the Kyrgyz Republic to the Customs union of the Republic of Belarus, the Republic of Kazakhstan and the Russian Federation approved by the order of the Government of the Kyrgyz Republic No. 445 of August 5, 2014, we order:

1. Approve the enclosed Order of interaction of authorized state bodies of the Kyrgyz Republic at air check points through customs border of the Eurasian Economic Union (further - the Procedure).

2. To heads of the state bodies involved performed by this order:

- determine responsible persons for strict observance and execution of the Procedure approved by this order and to inform the State Customs Service under the Government of the Kyrgyz Republic in week time;

- post this order on the official sites of state bodies;

- provide bringing to data of interested persons;

- provide control of execution of this order.

3. This order becomes effective from the effective date Treaties of Accession of the Kyrgyz Republic to the Agreement on the Eurasian Economic Union of May 29, 2015.

Order of interaction of authorized state bodies of the Kyrgyz Republic at air check points through customs border of the Eurasian Economic Union

I. General provisions

1. This Order of interaction of authorized state bodies of the Kyrgyz Republic at air check points through customs border of the Eurasian Economic Union (further - the Procedure) determines the sequence of control actions when implementing border, customs and other control (further - the state control) at air check points through customs border of the Eurasian Economic Union (further - check points).

2. The state control is exercised at check points by officials of authorized state body on protection of frontier, authorized state body in the field of customs affairs, authorized state body in the field of health care, authorized state body on supervision and control in the field of veterinary and phytosanitary safety (further - the state regulatory authorities) within the powers established by the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic.

3. When implementing the state control means and methods according to the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic are applied.

4. The state control at check points is carried out concerning the aircrafts (further - AF) going from/in the foreign states, and also going on them persons, loads, goods and animals.

5. The dispatching service of the airport (airfield) till 17:00 o'clock prior days represents to divisions of the state regulatory authorities performing the functions at the airport, the daily plan of flights of AF taking into account regular flights of AF (according to the schedule of movement of AF) and irregular flights of AF (out of the schedule of movement of AF).

All changes in the daily plan of flights of AF are approved by dispatching service of the airport (airfield) with the state regulatory authorities.

6. The state control AF is exercised on parking of the aircrafts determined by dispatching service of the airport (airfield) in coordination with bodies of border, customs and sanitary and quarantine control (in case of arrival of AF from zone with adverse sanitary and epidemiologic situation).

Survey of AF, following with the short-term parking (technical landing) at the international airport (airfield) in the territory of the Kyrgyz Republic, according to the decision of the state regulatory authorities at the check point can not be carried out. Other control actions concerning specified to AF are performed by the state regulatory authorities in the sequence determined by this Procedure.

For all the time of stay of such AF at the international airport (airfield) in the territory of the Kyrgyz Republic on its parking additional regime restrictions are set.

9. The state control of passengers and members of crews of AF is performed in specially equipped rooms of the check point.

For the purpose of simplification of control procedure concerning owners of diplomatic passports, members of crews of aircrafts, transients, passengers with small children and the passengers needing the special help (disabled people) at check points special conditions (certain canals) for implementation of control actions concerning the specified categories of persons in priority procedure can be created.

In some cases according to the decision of bodies of border and customs control implementation of the state control of crew members of AF and separate categories of passengers onboard AF or at its ladder is allowed.

10. The state control of loads, goods and animals is performed in specially equipped rooms and on the platforms of the check point including equipped with the equipment for pogruzo-unloading works.

II. The sequence of implementation of control actions in case of the state control of persons, vehicles, loads, goods and animals arriving to customs area of the Eurasian Economic Union

11. The actions of the state regulatory authorities performed on the parking and onboard AF:

- having received the message (the telegram about departure of AF) with indication of number of flight, the AF type, board number and other necessary information, the dispatching service of the airport (airfield) of arrival informs on it the state regulatory authorities;

- after receipt of the message on landing of AF the state regulatory authorities arrive to the parking of AF;

- for AF from the moment of its landing and before statement on the parking bodies of border control perform observation;

- on the parking of the arrived AF additional regime restrictions are set. Access for persons to AF and to AF during implementation of the state control is limited, and in case of need - it is forbidden;

- the bringing (opening) of ladder to the arrived AF is made with the permission of bodies of border control;

- bodies of sanitary and quarantine control the first rise aboard AF, estimate sanitary and epidemiologic situation and within the competence make the decision on acceptance of AF or need of implementation of other actions for sanitary quarantine control;

- the state regulatory authorities conduct survey of the commander of AF on the questions connected with implementation of the state control;

- the commander of AF provides to the state regulatory authorities the documents necessary for implementation of the state control;

- the senior of border duty grants permission for disembarkation of persons which arrived to AF and in coordination with bodies of customs control on unloading of baggage and loads;

- after disembarkation of persons which arrived to AF of unloading of baggage and loads the state regulatory authorities perform survey (in the presence of the bases - examination) AF;

- upon completion of survey (in the presence of the bases - examination) AF on the parking lifts additional regime limits;

- according to the decision of bodies of border control the arrived persons from parking of AF to venues of the state control it can be transported in case of maintenance by border duty.

12. Actions for implementation of the state control of the arrived persons and their baggage:

- sanitary and quarantine control of the arrived persons is exercised in the presence of the corresponding sanitary and epidemiologic bases;

- verification of documents at the arrived persons is performed by border duties in cabins of passport control in air terminal complexes or specially equipped rooms;

- customs control of the arrived persons and their baggage is carried out in specially equipped room of the check point (air terminal) where check by customs authority of documents of the arrived persons and their baggage on compliance to requirements of the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic is performed;

- are checked by bodies of customs control reliability of the data containing in documents and survey, joint (if necessary) with other state regulatory authorities (in the presence of the bases - examination) the arrived persons and their baggage is made;

- in case of identification during customs control of availability at the arrived persons in hand luggage or baggage of small pets, products of animal origin or quarantine products veterinary or phytosanitary control is exercised.

13. Actions of the state regulatory authorities for implementation of the state control of the loads, goods and animals who arrived to AF:

- survey of loads by bodies of border and customs control is performed, as a rule, on the parking of AF during its unloading;

- customs control of the loads which arrived to AF, goods and animals is performed in the following sequence:

- the customs authority receives the documents determined by the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic from carrier (the operator of AF) checks reliability of the data containing in the documents necessary for carrying out customs control. Sends the documents necessary for implementation of other types of control, to the relevant state regulatory authorities;

- bodies of sanitary and quarantine, veterinary, phytosanitary control check reliability of the data containing in documents concerning loads, goods and the animals who are subject to the corresponding type of control. In case of decision making on carrying out cargo inspection and goods inform on it customs authority;

- the customs authority will organize and coordinates carrying out by the interested state regulatory authorities of joint examination of the loads and goods which arrived to AF.

III. The sequence of implementation of control actions in case of the state control of persons, vehicles, loads, goods and animals decreasing from customs area of the Eurasian Economic Union

14. The actions of the state regulatory authorities performed on board and on the parking of AF:

- in case of technical readiness of AF for departure the dispatching service of the airport (airfield) at least for hour to departure informs the state regulatory authorities on readiness of AF for loading with indication of number of flight, the AF type, board number, departure time, airport of destination, number of the parking;

- the preliminary information on departure shall contain stipulated by the legislation the Eurasian Economic Union and the legislation of the Kyrgyz Republic of the data on AF, carrier (the operator of AF), persons following on AF, loads, goods and animals;

- after receipt of the message on readiness of AF for loading the state regulatory authorities arrive to the parking of AF;

- on the parking of the decreasing AF additional regime restrictions are set. Access for persons to AF and to AF during implementation boundary and other types of control is limited, and in case of need - it is forbidden;

- the state regulatory authorities conduct survey of the commander of AF on the questions connected with implementation of the state control;

- the commander of AF provides to the state regulatory authorities the documents necessary for implementation of the state control;

- the state regulatory authorities perform joint survey (in the presence of the bases - examination) AF;

- the senior of border duty gives landing permit of faces decreasing on AF (further - the decreasing faces), and in coordination with customs authority on loading of baggage and loads;

- survey of the decreasing loads is performed by boundary and customs authority, as a rule, on the parking of AF during its loading.

15. Actions of the state regulatory authorities for implementation of the state control of persons and their baggage:

- sanitary and quarantine control of the decreasing faces is exercised in the presence of the corresponding sanitary and epidemiologic bases;

- veterinary, phytosanitary control is exercised only in case of availability at the decreasing faces of the goods which are subject to the specified types of the state control;

- customs control of the decreasing faces and their baggage is carried out in specially equipped room of the check point (air terminal) where verification of documents of the decreasing faces and their baggage on compliance to requirements is performed by the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic;

- the customs authority checks reliability of the data containing in documents and makes survey, joint (if necessary) with other state regulatory authorities (in the presence of the bases - examination) the decreasing faces and their baggage;

- verification of documents at the decreasing faces is performed by border duties in cabins of passport control in air terminal complexes or specially equipped rooms;

- according to the decision of boundary body the decreasing faces from the air terminal building on parking of AF it can be transported in case of maintenance of border duty.

16. Actions of the state regulatory authorities for implementation of the state control of the loads, goods and animals decreasing on AF (further - the decreasing loads, goods and animals):

- the consignor or person authorized by him provides to customs authority, and also bodies of sanitary and quarantine, veterinary, phytosanitary control the documents necessary for implementation of the corresponding type of control;

- bodies of sanitary and quarantine, veterinary, phytosanitary control check the relevant documents and inform customs authority on possibility of the omission of the decreasing loads, goods and animals through customs border of the Eurasian Economic Union or on need of carrying out survey (in the presence of the bases - examination) the decreasing loads, goods and animals;

- the customs authority checks reliability of the data told customs authority containing in documents and performs other actions for customs control concerning the decreasing loads, goods and animals according to the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic;

- the customs authority and other interested state regulatory authorities performs joint inspection (in the presence of the bases - examination) the decreasing loads, goods and animals;

- the state regulatory authorities make the decision on the omission of the decreasing loads, goods and animals through customs border of the Eurasian Economic Union;

- the customs authority informs the consignor or person authorized by it on the made decision concerning the decreasing loads, goods and animals;

- documents are transferred to the decreasing loads, goods and the decreasing animals which are drawn up according to the legislation of the Eurasian Economic Union and the legislation of the Kyrgyz Republic by the state regulatory authorities to the commander of AF;

- distillation (closing) of ladder of AF is made with the permission of the senior border duty;

- after distillation (closing) of ladder of AF to its departure (the beginning of independent movement) border duties perform observation;

- after departure of AF on the parking additional regime limits are lifted.

IV. Features of implementation of control actions by the state regulatory authorities in case of the state control of separate categories of persons

17. The transients who do not have the entrance right to the territory of the Kyrgyz Republic in the presence of properly processed documents on the right of entry into the state of appointment and air tickets with the confirmed date of departure from the airport of change in the territory of the Kyrgyz Republic within 24 hours from the moment of arrival can accommodate in the transit hall of the airport or visa-free (controlled) zone of hotel of the airport. Timely departure of specified persons from the territory of the Kyrgyz Republic is provided with carrier (person rendering services in air transportation of passengers) and service of transit of the airport. By boundary bodies separate control actions for verification of documents of the specified category of persons for the purpose of check of observance of terms of stay in the international airport by them can be carried out.
