About modification and amendments in the Law of the Republic of Armenia "About the value added tax"

Article 1. In article 6.1 of the Law of the Republic of Armenia ZR-118 of May 14, 1997 "About the value added tax" (further – the Law):

1) to remove the words "exceeding 200 million dram" from part 1 and before the last paragraph to add part with the new paragraph of the following content:

"VAT amounts which payment was postponed according to this part are subject to payment in the government budget before the expiration.".

To state 2) to part 2 and 3 in the following edition:

"2. Before the expiration of the renewal term established by part one of this Article, as regards prolongation of payment due date of the amounts calculated by customs authorities specified in part one of this Article of goods stops (there is obligation on payment of the VAT) according to the written application of the taxpayer submitted to customs authorities next day after submission of the statement, and the VAT amounts specified in the statement are subject to payment in the government budget in 10-day term after the termination of prolongation of payment due date.

3. The VAT amounts calculated by customs authorities as regards the goods specified in part one of this Article can be extinguished by means of transfer according to the law of the VAT amounts which are subject to transfer and (or) return for other tax liabilities of the taxpayer as regards the transactions assessed on zero rate of the VAT by means of renewal of the amount of return.

In case of failure to pay VAT amounts for the term established by parts 1 and 2 of this Article, calculation of the penalties established by the law and control over these amounts exercises customs authority. The VAT amounts and penalties calculated by tax authorities, the amounts calculated for unpaid at the scheduled time, are paid as the amounts of charges by customs authorities of the government budget.".
